Gavin and Terese J. Gavin Bk.: #29335 <br /> 150 Pimlico Pond Road Pg.: #176 <br /> (Map 2 Parcel 136) <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 23, 2019 by John F. and Terese J. Gavin requesting a <br /> Written Finding under §174-17 of the Zoning Bylaws to allow for construction of a <br /> bathroom in a detached garage on property located in an R-5 Zoning District, at 150 <br /> Pimlico Pond Road,Map 2 Parcel 136,Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 31, 2019 and June 7, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 26, 2019 at which time the following members of the Board of Appeals <br /> were present and acting throughout; Chairman, Jonathan Furbush, Board Members, Ron <br /> Bonvie, Scott Goldstein, and Associate Members, Sharon Sangeleer and George <br /> Ganzenmuller. <br /> Mr.Matthew O'Connell,with ADG Inc.,represented the homeowners for their raze <br /> and replace project. Terese Gavin,homeowner was also present. The proposal is to remove <br /> an existing non-conforming single-family residence that currently violates the side yard <br /> setback, and replace it with a fully conforming new single-family home and a detached <br /> garage. <br /> Mr. O'Connell said that the plan was revised at the request of the Conservation <br /> Agent depicting the top of the inland bank.He said there is no work being performed within <br /> the 100 ft. buffer, and he is not requesting any variances. <br /> The Board noticed that the topography of the lot drops significantly toward the <br /> inland bank. <br /> 1 <br />
