Robertson Pg. 217 <br /> 22 Sunset Circle <br /> (Map 64 Parcel 16) <br /> Mashpee, MA 02649 <br /> A Petition was filed on May 28, 2019 by Owners, Lawrence D. and Marie C. <br /> Robertson requesting a Written Finding under §174-17 of the Zoning Bylaws to allow for <br /> construction of a 12' x 22' shed on property located in an R-5 Zoning District,at 22 Sunset <br /> Circle, Map 64 Parcel 16, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 31, 2019 and June 7, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 26, 2019 at which time the following members of the Board of Appeals <br /> were present and acting throughout; Chairman, Jonathan Furbush, Board Members, Ron <br /> Bonvie, Scott Goldstein, and Associate Members, Sharon Sangeleer and George <br /> Ganzenmuller. Also present was Charlie Maintanis, Building Inspector. <br /> The homeowners represented themselves for the application to install a shed. Mr. <br /> Robertson said that the reason for the Zoning Board filing is because of a pre-existing non- <br /> conforming condition on the front property line. Mr. Robertson said that he is having a <br /> shed company deliver and install a pre-fab shed. He is not looking for a variance. <br /> The Board questioned the proper setbacks because the shed is over 120 sq. ft. The <br /> shed requires to be 15 ft. from the side and rear property line. Chairman Furbush asked the <br /> Building Inspector if the shed requires footings. He said that the shed needs to meet the <br /> building code requirements. <br /> Mr. Bonvie recommended that the applicant set the shed 15 ft. 2 inches from the <br /> property line to avoid any error in setbacks on the placement of the shed, and variance <br /> relief if an as-built is required. <br /> 1 <br />
