Bk: #24597 <br /> Owner of record: JCK Commercial Street, LLC Pg.: #318 <br /> 153 Commercial Street (Map 88 Parcel 37-0) <br /> Mashpee, MA 02649 <br /> A Petition was filed on April 18, 2019 by Petitioner, RCA Electrical Contractors <br /> request a Special Permit under §174-25 (G) (4) and (G) (6) of the Zoning Bylaws to allow for <br /> the use of an electrical shop for wholesale and storage on property located in an I-1 Zoning <br /> District, at 153 Commercial Street, (Map 88, Parcel 37-0), Mashpee, MA. (Owner of Record: <br /> JCK Commercial Street,LLC). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 17,2019 and May 24, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 12, 2019 at which time the following members of the Board of Appeals <br /> were present and acting throughout; Chairman,Jonathan Furbush,Vice Chairman,William <br /> Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, and Norman J. Gould. Also <br /> present was Charlie Maintanis,Building Inspector. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Attorney,David Lawler represented the applicant RCA Electrical Contractors.Also <br /> present was Donna and Randy Agnew, Principals. The Attorney mentioned that the <br /> applicants applied and were awarded a Special Permit on Evergreen Circle, but decided to <br /> withdraw the purchase of that parcel. He said his clients are now under a contract with the <br /> property at 153 Commercial St. He said this application does not require any changes to <br /> the exterior portion of the existing building; so there were no plans submitted. It is strictly <br /> a "use" only application. The Attorney said that the use for an electrical shop is far less <br /> detrimental to the neighborhood than what currently exists, and his clients preferred to <br /> present their request to the Zoning Board for a Special Permit. The use is consistent with <br /> State and Town regulations. There are no adverse effects to health and safety, and there are <br /> no abutting wetlands. This is an allowed use, and his clients will clear the property of any <br /> debris. The interior will have storage of electrical materials. The employees will arrive in <br /> the morning, obtain their work orders and materials and leave for their work day. There <br /> will be an office that will have four or five employees in house. The electricians and <br /> engineers will come and go during the day. <br /> 1 <br />
