MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Petitioner, RCA Electrical Contractors, Inc. <br /> Owner of record: JCK Commercial Street, LLC <br /> 153 Commercial Street(Map 88 Parcel 37-0) <br /> Mashpee, MA 02649 <br /> SP-2019-30 <br /> Board Member, Ron Bonvie quoted the Special Permit bylaw section that a site <br /> plan is required under Section 174-25. <br /> Attorney Lawler said he originally thought that a letter from the Building <br /> Department would suffice for this particular use, but he preferred to respectfully submit <br /> this request to the Board. He thought that since a site plan was approved on the original <br /> Special Permit, it is incidental, and would be sufficient for this application and satisfy the <br /> Board. He said;this is an extremely life changing purchase for his clients, and they wanted <br /> to take the conservative approach for the Board's approval. <br /> Building Inspector, Charlie Maintanis said that the bylaw Section 174-25 (G) 4 is <br /> not on the original Special Permit, but all the other bylaws are listed. <br /> Board Member,Ron Bonvie asked if there was any changes being made that would <br /> require a building permit. The Attorney said; no changes. <br /> Chairman Furbush did not have any issues with the project. <br /> Board Member, Bill Blaisdell read the Board of Health comments into the record. <br /> There were no other comments from the Board or audience. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Special Permit. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday, June 12,2019,the Zoning Board of Appeals voted unanimously to issue RCA <br /> Electrical Contractors at 153 Commercial St., a Special Permit,under §174-25 (G) (4) and <br /> (G) (6) of the Zoning Bylaws to allow for the use of an electrical shop for wholesale and <br /> storage on property located in an I-1 Zoning District, (Map 88, Parcel 37-0), Mashpee, <br /> MA. (Owner of Record: JCK Commercial Street, LLC), with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2. Conditioned on all Town Department comments read into the record. <br /> 3. The Building that exists today is in compliance, and will remain in compliance with <br /> the Baxter Nye Engineering&Surveying plan entitled: "Capewide Enterprise,LLC <br /> 153 Commercial Street(Formerly#203 Industrial Drive), Mashpee, MA. Prepared <br /> for: Capewide Enterprises, LLC, Date: 4/02/10, 04/22/10, Revisions Per Site Plan <br /> Review, C-1.0 through C-5.0.
