Thompson <br /> requesting a Special Permit under §174-17.1 of the Zoning Bylaws to raze and replace a <br /> single family non-conforming structure on property located in an R-3 Zoning District, at <br /> 175 Daniels Island Road, Map 100 Parcel 41, Mashpee, NIA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 3, 2019 and May 10, 2019 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 22, 2019 at which time the following members of the Board of Appeals <br /> were present and acting throughout;Chairman,Jonathan Furbush,Vice Chairman,William <br /> Blaisdell,Board Members,Ron Bonvie,Norman J. Gould,and Associate Member, Sharon <br /> Sangeleer. <br /> Attorney Kevin Kirrane represented the homeowners in connection with their raze <br /> and replace project. The Board can grant a Special Permit based on the fact that there are <br /> no new non-conformities created.The lot is 13,200 sq.ft.,and consists of a non-conforming <br /> single-family structure. The lot sits only 26.1 ft. from Daniels Island Road, and does not <br /> comply with the 40 ft. setback requirements. It is 7.8 ft. on the southerly boundary line and <br /> therefore does not comply with the 15 ft. setback requirement. The current structure sits 34 <br /> ft. from the coastal bank and is non-conforming to the 50 ft. setback from the wetland <br /> resource areas. <br /> 1 <br />
