Coffman, <br /> Trustees requesting a Variance under §174-33 of the Zoning Bylaws to allow for <br /> construction of an addition within the wetland resource area on property located in an R-3 <br /> Zoning District, at 105 Whippoorwill Circle, Map 125 Parcel 150, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on March 22, 2019 and March 29, 2019 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 10, 2019 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Member, Scott.Goldstein, Norman J. Gould, and Associate Member, Sharon Sangeleer. <br /> Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Tim Luff, Archi-Tech Associates represented Mr. Timothy Rassias who will <br /> be purchasing the property. Mr. Luff is the designer of the project application is regarding <br /> the existing garage and breezeway. The applicant wanted to rework the floor plan with new <br /> windows, new dormers, new staircase, etc. When starting the design, he reviewed the <br /> existing conditions,and created floor plans. There were two different designs,one for more <br /> volume on the second floor, and one that works exactly within the roof line. Mr. Luff said <br /> that his client chose the option for the larger floor plan. Mr. Luff said he decided that the <br /> roof would need to be removed to accomplish that design. It was discovered that the <br /> existing foundation was concrete block, and realized that there was no footings. After <br /> consulting with a structural engineer, they realized that this project would require to pour <br /> a new foundation. The Building Department was comfortable to let the project move <br /> forward as a renovation project. Mr. Bob Fox,the Contractor and Mr. Luff spoke with Mr. <br /> Mendoza and at that point it was discovered that the project required to go before the ZBA <br /> because the structure will be torn down, and reconstructed with a new poured foundation <br /> in the same footprint. <br /> 1 <br />
