MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Homeland Group Realty, LLC <br /> 105 Whippoorwill Circle(Map 125 Parcel 150) <br /> Mashpee, MA 02649 <br /> V-2019-24 <br /> The setbacks all comply, the lot coverage is fine, the height restriction is fine, and <br /> the project was approved by the Conservation Commission. It was the requirement for a <br /> new foundation that the Building Department made the determination that this project <br /> requires the application to the Board. <br /> Mr. Luff spoke to an abutter that wanted to see the plans of the project. The existing <br /> house has three bedrooms. The proposal is to remove one bedroom. Mr. Goldstein wanted <br /> to confirm the floor plan layout showing the existing two storage areas, and family room. <br /> Mr. Luff said that they are removing a bedroom to utilize the storage area, bring the floor <br /> up, so there's no steps down, and install a new staircase. Mr. Goldstein confirmed there is <br /> a 6 ft. cased opening. There will only be three legal bedrooms. <br /> Mr. Goldstein reviewed the plans with the Board members showing that currently <br /> there are three steps, with a family room, an illegal bedroom and two storage areas. The <br /> proposed plan is to make the new structure one level removing the steps. There will be a 6 <br /> ft. clear opening, a family room, a bathroom, a staircase going up with another 6 ft. clear <br /> opening with an office, and no bedrooms. <br /> Mr. Luff said the project will be a gym, and will have an open staircase. The garage <br /> is gone. <br /> There were no more comments from the Board or audience. <br /> Mr. Goldstein read the Board of Health comments dated April 9, 2019 into the <br /> record. The proposed addition must be unheated, and must have an open rail overlooking <br /> the lower level. <br /> Mr. Mendoza suggested to the Board that he will reach out to the Board of Health <br /> explain the situation and will ask for a corrected letter and will forward to all the members. <br /> Mr. Furbush said that a condition will be made that a revised letter will be required <br /> from the Board of Health. <br /> Ms. Sangeleer read the Conservation Commission comments into the record that it <br /> was approved at the March 28th meeting, and the DPW comments, and Inspection <br /> Department comments into the record. <br /> GENERAL CRITERIA: <br /> The subject property located at 105 Whippoorwill Circle is approximately 26,000 <br /> square feet upland. <br /> There was one abutter present. <br /> 2 <br />
