MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Karl Schneider and Jill Schneider <br /> 14 Nick Trail (Map 117 Parcel 241) <br /> Mashpee, MA 02649 <br /> FINDING-2019-18 <br /> The corner of the mud room addition is 12 ft. which is one foot further away from <br /> the leaching field than the existing house. Steve said he will draw his construction plans <br /> and discuss the crawl space slab with Glen Harrington to verify if a variance was issued. <br /> Lot coverage is currently 16.2%, and will be 19.9% and well under the 25%maximum. <br /> Mr. Bonvie asked if the applicant was expanding or creating any new non- <br /> conformities on this lot. Steve said; no. He said the only reason the house is non- <br /> conforming is because of the front setback at 23.8 ft. There's an existing 3 ft. crawl space <br /> underneath the house,the leach field is within 11 ft. of the existing crawl space. The Board <br /> of Health previously permitted this.The new proposed addition is 12 ft. away, so he gained <br /> a foot difference. Steve said he will either make a slab or a small crawl space. The leach <br /> field is 2 ft. below grade; the concrete slab will be at grade or above. The house is also in <br /> a flood zone, and he will have to provide vents in the crawl space. He will work with Glen <br /> in Board of Health. <br /> The Board reviewed the plans and noticed the house is on a corner lot. There were <br /> no more questions from the Board. <br /> Mr. Furbush read the Board of Health comments into the record. Sharon read the <br /> Conservation and Inspection Department comments into the record. Mr. Furbush read the <br /> DPW comments into the record. <br /> There were no comments from the audience. <br /> GENERAL CRITERIA: <br /> The subject property located at 14 Nick Trail is approximately 6,500 square feet. <br /> WRITTEN FINDING CRITERIA: <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or <br /> uses may be continued, although not conforming with the provisions of this chapter. Non- <br /> conforming single- or two-family dwelling structures may be changed, extended or altered <br /> if such change, extension or alteration complies with the dimensional requirements <br /> applicable to the lot under current provisions of §174-31 or, for lots which have been <br /> developed pursuant to §174-21, complies with such requirements as were applicable to <br /> initial construction of the dwelling under provisions of§174-21. <br /> 2 <br />
