maintenance and drainage facilities. The purpose of this filing is to delineate a limit of work area
and a vista corridor. There will be no clearing of these sites at this time, per conversation with the
Agent. If the lots are to be developed in the future, then separate filings will come forward with an
Amended Order. The 50-foot buffer is delineated from the most-landward Coastal Bank
delineation and will not be disturbed. The Agent stated a revised narrative will be provided to
clarify the building envelopes will not be cleared at this time, and when clearing occurs an AOOC
Will be applied for to determine the exact footprint of all the aspects of development. The vista
pruning corridor has been delineated in accordance with Regulation 27 and may be moved based
on the house location. The Agent clarified there will be two special conditions: the maintenance
of the stormwater management system and that the area cannot be cleared until more details are
provided for landscaping and hardscaping, grading, and septic installation. The Agent asked if
the fact two properties are on the same permit is acceptable to the Registry of Deeds and if it
would raise an issue for future filings; Matt Costa stated it will be recorded under both titles and
there would be no issue, and he went forward with this filing to satisfy the stormwater maintenance
concerns.
Public Comment: Abutter from 18 Quaker Run, Peter Merlino, inquired on behalf of the
neighborhood what will occur once the road is re-established to the pier and Mitchell's Landing in
regard to parking and access. The Agent stated it was previously approved to clear the road, and
the current and new lot owners will ultimately decide the use of it. Mr. Merlino stated people do
access the pier now. The Agent stated any trespassing is a civil matter, and clarified this portion
of Simons Narrows Road is not town-owned, nor is Mitchell's Landing.
Resource Areas: Land Under Ocean, Land Containing Shellfish, Coastal Bank, Salt Marsh,
Bordered Vegetated Wetland
No comment from the public.
Motion: Mr. Smith moved to Close and Issue, seconded by Mr. Dalton, with the
understanding the sites will not be cleared until the Commission is shown the footprint of
the building sites. Vote unanimous 5-0.
6:18 p.m. Donna M. McDonald, Trustee, 14 Capstan Circle. Proposed repair and
maintenance of existing stone wall. At request of applicant, continued from 7/11/2019. The
homeowner Donna M. McDonald and the contractors were present. They failed to attend the
meeting on 7/11/2019. The contractors stated that portions of the rock wall were failing apart on
some parts of the wall. They plan to dig into these areas, add filter fabric behind, and place rocks
back. The Agent stated it is a licensed low-profile retaining wall with a Chapter 91 License that
has a maintenance-in-perpetuity clause to repair within the same footprint, and the work will be
concentrated in the slumping areas. It has preceded the Bylaw, hence there is no permit for the
wall on record, and using the original Chapter 91 plan is acceptable.
Resource Areas: Coastal Bank, Salt Marsh, Flood Zone
No comment from the public.
Motion: Mr. Smith motioned for a Negative Determination, seconded by Mr. Dalton. Vote
unanimous 5-0.
3
