Vote
unanimous 5-0.
6:06 p.m. Johns Pond North Cove Association, 4 & 5 Shorewood Drive (NOI) . Proposed
beach nourishment, beach raking and tree pruning. The applicant Billy Perry, president of the
Association, was present. The Agent stated there has not been a DEP number issued for this
filing yet because they did not receive proof of mailing to the Natural Heritage Endangered
Species Program and deficiencies were present in the resource areas cited in the NOI application.
Therefore, the Commission is unable to conduct the hearing tonight. The applicant requested a
continuance, and will meet with the Agent to rectify the issues in the meantime.
No comment from the public.
Motion: Mr. Sweet motioned for a continuance to 81812019 @ 6:03 p.m., seconded by
(inaudible). Matt Costa of Cape & Islands Engineering represented the applicant.
He stated the current system has failed and will be replaced with a Title V system in previously
disturbed flood zone areas. Only a small portion of the work with occur within the 100-ft buffer
zone to salt marsh (part of pump chamber and a small portion of the leach field). The existing
system is too close to ground water, and the replacement will result in a net environmental benefit.
The Agent stated it was straight forward, and the Board of Health is currently reviewing the project.
Most of the work will occur in a flat lot within the clamshell driveway and lawn areas, and there is
no anticipated adverse impacts to the resource areas. The Agent recommended a limit of work
be installed, per the plan.
Resource Areas: Land Under Ocean, Land Subject to Coastal Storm Flowage, Salt Marsh
No comment from the public.
Motion: Mr. Smith motioned for a Negative Determination, seconded by Mr. Dalton.
