6:12 p.m. John Curring, 0 Simons Narrows Rd (RDA): Matt Costa of Cape & Islands <br /> Engineering described the project which involves removal of overgrown vegetation on paved <br /> road layout,.repave road and construction of drainage swales at the end of the road layout/cul- <br /> de-sac area. There was some discussion on road ownership. Mr. Costa said that a NOI has <br /> been filed with conservation for maintenance of the drainage system. This NOI will be reviewed <br /> on July 11th, 2019. There was some additional discussion about public/private access along the <br /> road and ownership clarification. Agent recommended a Negative Determination, <br /> Resource Areas: LSCSF, buffer zone to BVW, salt marsh and Land Under Ocean/LCS <br /> Motion: Mr. Sweet moved for a Negative Determination, seconded by Mr. Smith. Vote 5- <br /> 0 unanimous <br /> 6:15 p.m. Daniel Candura, 74 Fells Pond Rd (RDA): Rob DeMello of DeMello Brothers Inc. <br /> presented the project to the commission, which includes various landscape and hardscape <br /> improvements on the property. Mr. DeMello described various landscaping areas around the <br /> home in need of restoration as they were disturbed by excavation from a septic upgrade project. <br /> Additionally, the entire paved driveway was removed as part of the septic work. The homeowner <br /> proposed.to repave most of the driveway with the exception of the end near the home. This <br /> area will be hardscaped with pavers and be made semi-pervious to absorb runoff down the <br /> driveway. The commissioners had some questions about the extent of landscape/hardscape <br /> improvements. The Agent stated there are no impacts to inland bank or Fells Pond. All proposed <br /> work is occurring in previously disturbed/landscaped/hardscaped areas. Agent recommended a <br /> Negative Determination. <br /> Resource Areas: Buffer zone to Top of Inland Bank leading to Fells Pond. <br /> Motion: Mr. Smith moved for a Negative Determination, seconded by Mr. Sweet. Vote 5-0 <br /> unanimous. <br /> 6:18 p.m. Leonardo Caruso, 43 Little Neck Ln (AOC 43-2932): Matt Costa of Cape & Islands <br /> Engineering described the project (Mary LeBlanc Landscape Design provided the plan), which <br /> includes landscaping,. mitigation plantings, proposed generator, gas fire pit, brick patio, lawn <br /> installation and invasive species management. Additionally, the existing timber retaining wall is <br /> included in this application with assurance that the wall was constructed properly. Agent <br /> reiterated the background on this project and details on the retaining wall, which was constructed <br /> by Briggs Landscaping and administratively approved previously by the Agent. Briggs <br /> Landscaping submitted a schematic of the retaining wall showing how it was built. There was <br /> some exchange between the consultant and the commission. Akram Rafla, abutter to the <br /> property (45 Little Neck Ln) raised concerns about the previous removal of an arborvitae hedge <br /> on the property line between his home and Mr. Caruso's. The Agent explained that the <br /> arborvitae was removed from a permitted septic upgrade project and there were no issues with <br /> the removal of what is considered ornamental vegetation...there was no mitigation required for <br /> its removal either. Mr. Rafla asked if he could plant trees in this area and the commission <br /> informed him that he could through a permit application. <br /> Patrick Knight, the abutter on the other side of Mr: Caruso's property expressed concerns about <br /> the integrity of the retaining wall construction as it lies in very close proximity to the property line. <br /> The retaining wall is no higher than four feet and thus does not fall under building code <br /> jurisdiction; however, Mr. Knight claimed that he witnessed the wall construction and did not see <br /> proper drainage stone installed nor were there any drainage weep holes installed.
