consultant explained that no drainage pipes were installed because drainage would leach out <br /> onto the Mr. Knight's property. The commission recommended that the Agent schedule an <br /> onsite with the homeowner's contractor to have inspection holes dug at specified points along <br /> the existing wall to determine the presence of gravel behind the wall (underground) for drainage. <br /> The purpose of this is to assure the neighbor that the wall was constructed properly and will not <br /> fail and cause fill to be released onto Mr. Knight's property. The Agent recommended approval <br /> of this amended order request. <br /> Resource Areas: Buffer zone to coastal bank and Land Subject to Coastal Storm Flowage. <br /> Motion:Mr. Smith moved to approve the amended order request, seconded by Mr. Sweet. <br /> Vote 5-0 unanimous. <br /> 6.21 p.m. 391 Oak Ridge Avenue Nominee Trust, 401 Monomoscoy Rd (AOC-after the fact: <br /> 43-2351 : Michael Borselli of Falmouth Engineering presented the project to the Commission. <br /> This project involves hardscaping changes to previously proposed landscape retaining walls and <br /> associated grading on the property. The south side of the lot retaining wall changes had already <br /> taken place without benefit of prior review, thus warranting after the fact permit fees to apply. <br /> Essentially, this retaining wall was moved closer to the property line with the abutter to the south. <br /> The proposed landscape retaining wall to the north was proposed to be moved closer to that <br /> property line and regraded to accommodate foot traffic through this area of the property. Jaime <br /> Wienstein Sr., abutter to the north, provided a comment letter requesting that this wall be offset <br /> from his property line by 2-4 feet so the wall and any maintenance thereof, will be entirely <br /> contained on the applicant's property. The consultant had no issue with this change. The Agent <br /> recommended approval of the amended order with condition that the retaining wall be <br /> constructed 2 feet or more off the neighbor's property line. <br /> Resource Areas: Land Subject to Coastal Storm Flowage, buffer zone to salt marsh and BVW <br /> Motion:Mr. Smith moved to approve the amended order request, seconded by Mr. Dalton. <br /> Vote 5-0 unanimous. <br /> 6:24 p.m. Nathan McContha, 63 Timberlane Drive (RDA): Mr. McConatha described the <br /> project to the Commission which involves installation of a picket fence along the top of inland <br /> bank behind his home for safety reasons. Additional work includes removal of a portion of the <br /> paved driveway closest to the bank and landscape this area to address runoff down the paved <br /> driveway. Lastly, removal of small retaining wall off the driveway and creation of small parking <br /> area parallel to the existing driveway-near the road. This work would require removal of two <br /> mature trees and grading in this area. The Agent inquired whether the driveway addition would <br /> connect to the road and the applicant affirmed yes it would. The Agent informed the applicant <br /> that they must seek a curb cut permit from DPW and supply a copy of said issued permit to the <br /> Conservation Department prior to work proceeding. Agent recommended a negative <br /> determination with condition that applicant supply some mitigation plantings for the loss of two <br /> trees to accommodate driveway expansion. The chairman reiterated the mitigation to be worked <br /> out between the Agent and the homeowner. <br /> Resource Areas: Buffer zone to Top of Inland Bank associated with Santuit Pond <br /> Motion: Mr. Sweet moved for a Negative Determination with stated conditions, seconded <br /> by Mr. Smith. Vote 5-0 unanimous. <br /> 4 <br />
