MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 28,2019 <br /> Jonathan said he reviewed the July 24,2019 meeting minutes and had some questions. He <br /> asked how much of the natural buffer will be remaining. Matt said that it will be <br /> approximately 35 ft. from the property line, and will be lined with the plantings. Jonathan <br /> asked how much of the larger trees are remaining. Matt said there will be 21 trees <br /> remaining. He said the ones that he is removing range from scrubs to 1 to 2 inches in size. <br /> Jonathan read the comments from the Design Review minutes regarding the natural <br /> species. Matt said that he did not specify the names of the plants at Design Review,but the <br /> new plan submitted to the ZBA does include the names. Jonathan asked about the drainage. <br /> Matt said that the runoff water will be captured at the property line, and it will be managed <br /> on site. The areas within the layout that will be managed by DOT once received and will <br /> be tied into their system. Charlie Rowley has that information listed in his quote. <br /> Jonathan asked if they have reached out to the trustees at Shellback. Attorney Kirrane said <br /> that they spoke to the management company instead of the board members. <br /> Jonathan announced that he would like to hear from the audience but comments will be <br /> limited to three minutes. <br /> George Boiros, Vice Chairman of the Trustees, for Shellback Way. He spoke at the last <br /> hearing and expressed a lot of concern regarding the traffic, specifically the area he calls <br /> lower Shellback Way. He is trying to find the answer if Shellback Way is private or public. <br /> He said that they have been trying to get an answer since last year when someone hit a pot <br /> hole with their vehicle and they were responsible to repair it. He said that their Attorney <br /> has not defined whether it's a private or public road. <br /> Scott asked if the tenants at Deer Crossing use the road. Mr. Boiros said that he doesn't <br /> know the answer. Scott said there is no other access to the businesses behind that area. <br /> Jonathan asked if there is an agreement with the other businesses to share the maintenance <br /> costs. Mr. Boiros said that Mr. Davis with Mercantile Properties did meet with some folks <br /> at the bank, and the management company of the plaza,but was not sure what the outcome <br /> was. <br /> Mr. Carroll said he spoke to Mr. Davis, the property manager for Mercantile for the <br /> residential section of the condominiums. Mr. Carroll understands that it's a private way, <br /> and others have the right to pass. Mr. Davis does not manage the businesses. Jonathan <br /> asked how they would participate in the upkeep of the road. Mr. Boiros said it's informal <br /> right now.There's nothing written. Scott wanted to know if what was built first,the condos <br /> or the retail plaza. <br /> 4 <br />
