MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 14,2019 <br /> Ron asked if any interaction has occurred between the applicant,the Town and DPW about <br /> the concerns of the use of this site. Evan said the applicant's engineer has been in contact <br /> with the DPW. The applicant has every right to fill in that site given relief from the ZBA, <br /> and the DPW would have to accommodate that relief because they do not have any legal <br /> rights to discharge on that site. There has not been any identified legal easements to <br /> discharge on the property. <br /> Attorney Kirrane commented that when you combine the 26%undisturbed area on the lot <br /> together with the other landscaped areas of the lot, 51% of this lot is being retained as <br /> undisturbed or landscaped. <br /> Bill Blaisdell said a large portion of the disturbed but landscaped area of the 14%has to be <br /> disturbed and landscaped because it's completely useless, part is a basin and part is a big <br /> hole. <br /> Sharon read that there were no comments from Board of Health. Charlie said; no <br /> comments. <br /> Bob Lalime,a resident of 575 Main St.,read a letter that was written by Thomas and Lynn <br /> Wilson, of 581 Main St. They have concerns with the proposed building and use, and feel <br /> it will invade their privacy. They would like to see some buffer and screening landscaped <br /> on the undisturbed area. <br /> Jonathan announced and mentioned to the abutter that the request to the Zoning Board is <br /> not the use, it's for the Variance relief as written in the public hearing notice. Ron told the <br /> abutter that the Planning Board has not acted yet because they are waiting for the Zoning <br /> Board to make a determination to approve or disapprove of the Variance application. Evan <br /> described the application as well, and the Planning Board meeting is August 21, 2019. <br /> Art DePaul, an abutter on 16 Echo Road. He agrees that the 40% should remain <br /> undisturbed. <br /> There were no more comments from the audience. <br /> Attorney Kirrane said that the property will retain a significant portion of the area as <br /> undisturbed as shown on the plan, and if there is any activity outdoors in front of the <br /> building, it requires a screen, and his client will be more than willing to provide screening <br /> on those areas of concern. <br /> The Board wanted to know if there was a landscape plan. Attorney Kirrane said the intent <br /> includes to landscape above that depression, and plant trees above at ground level. <br /> 12 <br />
