If the Board is considering granting relief for this section of the bylaw to make <br /> a condition upon an activity plan that was issued to the Planning Board. Attorney Kirrane <br /> said that the Planning Board will be looking at the drainage to be retained on that site. <br /> The abutters are concerned with the other property owners requesting the same relief. <br /> Jonathan announced to the audience that a motion is always made in the affirmative. The <br /> Board will then vote in favor or against. <br /> Ron made motion that the Board issue a Variance to Modi, LLC of 10 Evergreen Circle <br /> under §174-25.1 (1) of the Zoning Bylaws to allow for relief from the minimum forty <br /> percent(40%) of the site shall be left in its undisturbed natural state on property located in <br /> a C-3 Zoning District, Map 19 Parcel 10; Mashpee, MA. (Owner of Record: Evergreen <br /> Energy, LLC), with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Variance <br /> under Mass General Law 40A Section 10. <br /> 2. Site Plan: Cape Cod Coffee, Located at #10 Evergreen Circle, Mashpee, MA. <br /> Owner: Evergreen Energy LLC, 81 Echo Rd., Mashpee, MA. Applicant: Modi, <br /> Inc., 348 Main St.,Mashpee,MA.
