Mr. Harrington went on to explain that there is currently no enforcement for noise created.by <br /> animals/poultry. He originally thought that any loud noise between 10 p.m. and 8 a.m. was <br /> prohibited by Town bylaw, but was recently advised by the Town Manager that the bylaw applies <br /> only to music. Under the board's "nuisance" definition, the noise would have to cause harm or <br /> the potential for harm and, in order to do harm to the human ear,the noise would have to reach <br /> at least 90 decibels. Mr. Harrington reminded the board that they can amend the regulation at <br /> any time. <br /> Ms. Almquist noted that the regulation requires a permit for composting, and Mr. Harrington <br /> explained that on-site composting can lead to rat issues. Ms. Langler suggested that "repeated <br /> documented noise..." should be moved to Section XIV of the regulation. Chair Baumgaertel <br /> suggested that Section XIV should be revised to read "sounds meeting the noise definition in <br /> Section II of this regulation shall be considered a nuisance." He further suggested that Section IV <br /> be corrected to read "the number of poultry shall comply..." Mr. Harrington stated that the <br /> Building Commissioner had requested there be a reference within the regulation to the number <br /> of birds that are permitted on a property—24 by right,and more than 24 by special permit only. <br /> Chair Baumgaertel asked what the current stable permit fee is,and Mr. Harrington answered that <br /> it is$50 for the first horse and$5 for each additional horse. Mr. Harrington noted that the poultry <br /> regulation has a registration requirement but no fee. Chair Baumgaertel asked if board members <br /> wanted to hold a public hearing prior to adopting the regulation. Mr. Harrington stated that, if it <br /> is not a septic regulation,the board can review and approve it at the time of the meeting. <br /> There being no further comments or discussion, Mallory Langler moved to approve the Poultry <br /> regulation with the recommended changes. Motion seconded by Laurel Almquist, VOTE: <br /> Unanimous(3-0). <br /> NEW BUSINESS <br /> 1. Review and approval of meeting minutes: May 16,2019 and June 6,2019 Public Session minutes <br /> were considered. <br /> There being no comments or revisions, Mallory Langler moved to approve the minutes of May 16, <br /> 2019 and June 6, 2019 as presented. Motion seconded by Laurel Almquist. VOTE: Unanimous <br /> (3-0). <br /> 2. Sign Expense Warrants. None presented. <br /> 3. Request for new Retail Food Permit,Little Shop of Olive Oils,12 Central Square, Mr. Harrington <br /> commented that the application, permit fee, floor plan, Allergen Awareness and ServSafe <br /> Certificates have been provided. The menu/product list had not been submitted, and the final <br /> inspection had not occurred yet. Mr. Harrington noted on the floor plan that the labeled hand <br /> sink was the washbasin in the bathroom,which cannot double as a dedicated hand sink. One will <br /> have to be added next to the mop sink or next to the three-bay sink. Ms. Langler noted that the <br /> applicant had provided evidence of Food Handler Certification only, and it was agreed that Food <br /> Protection Safety Manager Certification is needed. <br /> 5 <br />
