The crushed gravel driveway will not be paved, so the SAS will <br /> be vented, as required. Mr. Rivera also acknowledged two typos on the plan. <br /> Chair Baumgaertel asked Mr. Rivera if he had experience using H-20 loading access covers under a gravel <br /> driveway,and Mr. Rivera answered that this was his first time using them under gravel. Chair Baumgaertel <br /> asked if the lines could be extended beyond the edge of driveway so cleanouts can be outside of the <br /> driveway. Mr. Costa stated that he had performed a number of these cleanouts before and it is helpful <br /> to have them all accessible. He stressed that the gravel might shift but was not concerned about the <br /> covers shifting. Mr. Harrington stated that the whole pipe could be cleaned through one side, and Mr. <br /> Rivera agreed that, with continuous lines, maintaining only cleanouts outside of the driveway would be <br /> sufficient. <br /> There being no further comments or discussion, Mallory Langler moved to approve the septic plan for 22 <br /> Bright Coves Way as a variance, provided the cleanouts be removed from the driveway side of the <br /> leaching, and that the two typos on the plan are corrected. Motion seconded by Laurel Almquist. VOTE: <br /> Unanimous(3-0). <br /> 7:30—21 Evergreen Circle <br /> Mr. Harrington commented that this plan was reviewed during Site Plan review. The drainage and solid <br /> waste dumpster have been placed, and enclosed on a concrete pad. The Title V system is designed <br /> correctly and the floor plans have been reviewed. The use is commercial industrial for a lawn and tree <br /> service. The portion of the building that allows access for vehicles will have a floor drain connected to the <br /> industrial waste holding tank. The septic system is proposed below a parking area; therefore, a Title V <br /> variance was requested and added to the plan. <br /> Dan Ojala, from Down Cape Engineering, introduced himself for the record, stating that he was available <br /> to answer any questions the board may have. <br /> There being no further comments or discussion, Mallory Langler moved to approve the commercial site <br /> and septic plan for 21 Evergreen Circle with the added variance of the SAS below the parking area and the <br /> condition that standard commercial property conditions apply. Motion seconded by Laurel Almquist. <br /> VOTE: Unanimous(3-0). <br /> 7:35—100 Great Neck Road North <br /> Mr. Harrington commented that the owner, through his attorney, has requested a stay of the fines and <br /> an extension of time to perform the septic inspections. The fines that were issued were consistent with <br /> fines previously issued in similar situations. The property at 100 Great Neck Road North was sold on May <br /> 7,2019. An order letter was sent on June 24th,which the owner received June 26th. Attorney Phelps then <br /> contacted the BOH office on July 9th. The time between the sale of the property and the issuance of the <br /> first order letter was to determine if the new owner would take responsibility for and initiate the <br /> inspections. The failure to obtain a variance from the local Cesspool Regulation only further demonstrated <br /> that there was no due diligence on the part of the new owner. It was apparent that building construction <br /> and renovation started immediately after the sale, but the required elements of the sale were put off until <br /> the owner was ordered to take action. The owner and his representative have requested that the board <br /> work with them, but the priorities in which work is being done at the property show that the focus is not <br /> on the required aspects of public health. <br /> 3 <br />
