Attorney <br /> Phelps indicated that his client was prepared to explore that,as it was likely the cheapest option. <br /> Chair Baumgaertel stressed that addressing the condition of the current systems is the priority. The <br /> systems had not been pumped in three years, but Mr. Marichal's stated his intent to closely monitor them <br /> moving forward. Chair Baumgaertel inquired as to the nature of the Title 5 system failures, and Mr. <br /> Harrington answered that they were all hydraulic failure and there was evidence that two systems on the <br /> riverside were overflowing. Attorney Phelps stated that his client would like to pump on an as-needed <br /> basis, rather than commit to a pumping schedule. He indicated that there is a maintenance person on the <br /> premises 24/7, who can perform weekly checks on the systems. Ms. Langler felt it was unrealistic to <br /> expect one person to monitor all the systems, particularly if the units were at capacity. She was also <br /> concerned that Ready Rooter may not be available in the event an immediate pumping is necessary, and <br /> stated that an alarm system does not make sense in this situation. Board members agreed that pumping <br /> needed to be scheduled every two weeks and the frequency of pumping could be adjusted based on <br /> documentation by Ready Rooter of the condition of the systems. <br /> Mr. Marichal indicated that most changes of the initial changes to the property were made for safety and <br /> aesthetics. However, he informed the board that MassSave is replacing showerheads on all units, and <br /> changing out all faucets and toilets, resulting in less flow. He is also switching to high-efficiency washing <br /> machines. Mr. Harrington advised Mr. Marichal that wastewater from the laundromat is considered <br /> industrial, and cannot go into a Title 5 system. Mr. Marichal agreed to put a lockbox on the laundromat <br /> and restrict use to tenants only. Chair Baumgaertel inquired if there were any private wells in the <br /> immediate area, and Mr. Harrington answered that it is very possible; however, due to the size of the <br /> property, setbacks would likely be met and there would be no impact to the wells. Chair Baumgaertel <br /> inquired about the status of the underground storage tanks that were shown on the plan, and Mr. <br /> Harrington answered that it was an old plan and all the tanks had been removed. <br /> Board members were in agreement that the best course of action for the owner was to determine the <br /> feasibility of connecting to the WWTP. Mr. Harrington stated that this would be a lengthy process, with <br /> a couple of months of investigative engineering. Chair Baumgaertel requested that, if it was determined <br /> that sewer was not an option,the owner begin repairs/upgrades immediately. <br /> There being no further comments or discussion, Mallory Langler moved to continue discussion of the fines <br /> for 100 Great Neck Road North to next meeting, pending determination of the date of hire of Ready <br /> Rooter. Ms. Langler further moved that the laundromat be for resident use only until systems have been <br /> corrected; that the determination of the feasibility of connecting to WWTP be submitted within 30 days; <br /> and that a pumping contract be provided to the Health Department demonstrating that pumping will be <br /> performed every other week. Motion seconded by Laurel Almquist. VOTE: Unanimous(3-0). <br /> ADDITION TO AGENDA—49 Uncle Percy's Road <br /> At the request of Chair Baumgaertel, Mallory Langler moved to add the 49 Uncle Percy's Road variance <br /> request to the agenda. Motion seconded by Laurel Almquist. VOTE: Unanimous(3-0). <br /> Mr. Harrington commented that the current owners have submitted a request for a variance to sell the <br /> property at 49 Uncle Percy's Road without upgrading the existing cesspools. The buyers were contacted <br /> to attend the public meeting to discuss the conditions of the enforceable agreement that will mitigate the <br /> variance. <br /> 5 <br />
