They do not intend to immediately occupy the property. <br /> There being no further comments or discussion, Mallory Langler moved to approve the variance request <br /> for 49 Uncle Percy's Road with the condition that the buyer enter into an enforceable agreement,and the <br /> new system is installed within 90 days of the date of transfer. Motion seconded by Laurel Almquist. VOTE: <br /> Unanimous(3-0). <br /> OLD BUSINESS <br /> 1. Discussion of short-term rentals and proposed Assistant Health Agent position. Mr. Harrington <br /> commented that he continued the discussion of this topic from the last meeting because he <br /> wanted to see what the Selectmen were going to do with the short-term rental by-law. The Town <br /> Manager alluded to the fact that the Selectmen may want to submit a by-law version of their own. <br /> At the Selectmen's meeting earlier that week,they discussed doing just that. The Selectmen are <br /> also supporting a proposed by-law that allows accessory apartments by right, with no special <br /> permit or site plan review required. A by-law may be problematic if the board wants to do their <br /> own regulation, particularly for year-round rentals. If the board wants to do a rental regulation, <br /> perhaps go for year-round rentals, because we are still going to have to wrestle with them. <br /> The part-time Assistant Health Agent position has been joined with another new position called a <br /> Code Enforcement Officer. The Town Manager wants this new full-time position to cover by-law <br /> violations under the Building department, and rental property inspections under the Health <br /> department. This position would work out because the by-law violations that were to be covered <br /> were the sign violations. Once the sign violations diminish,the position would largely be a Health <br /> Agent. The warrant article that was submitted for the part-time position was replaced by the <br /> Selectmen with the code enforcement position. <br /> With respect to funding of the third-party consultant that will identify and notify the short-term <br /> rentals, Mr. Harrington's recommendation was to go with LodgingRevs for a cost of $12,780, <br /> because the Town would have access to the database for three months,which allows for time to <br /> build our own database. Harmari's price was cheaper but their quote was very general, so it was <br /> difficult to determine if they were offering the same services. Host Compliance/STR Helper was <br /> double the price of LodgingRevs for essentially the same services. <br /> Ms. Langler asked if these consultants identified year-round rentals and Mr. Harrington answered <br /> that they handled strictly short-term rentals. Chair Baumgaertel asked about funding for the <br /> enforcement part of the position, and Mr. Harrington answered that funding for the position <br /> would be budgeted and paid for from the general fund. <br /> There being no further comments or discussion, Mallory Langler moved to approve funding of the <br /> third-party short-term rental consultant at a cost of $12,780. Mr. Harrington commented that, at <br /> the last meeting, he was asked by the Chairman to check with the Assessor's Office whether they <br /> could place the board's restriction for the irrigation well and VOC testing on the Assessor's field <br /> card. The Assessor indicated that could be done, and said they would make sure it was in a <br /> location where it was visible when the card is printed. <br /> 6 <br />
