There being no further comments or discussion, Mallory Langler moved to approve the request <br /> for a variance from the Irrigation Well Regulation for 86 Wheeler Road, with the following <br /> conditions: 1) Annual VOC testing be performed, with all related costs to be the owner's <br /> responsibility. 2) A notarized affidavit be filed with the Board of Health stating the requirement <br /> for annual VOC testing. The affidavit include acknowledgments by the owner that they have been <br /> made aware of the presence and risks from exposure to the PFCs, and a that they have read and <br /> understand the EPA, DPH,and CDC guidance documentation on PFCs. The affidavit state that the <br /> irrigation well may be discontinued or abandoned under orders from the Board of Health, if <br /> required. 3) The spigot or sample port for the irrigation well be labelled "non-potable water"and <br /> located below grade to prevent free access. 4)An inspection be conducted to determine that the <br /> spigot has been properly labelled and that there is no cross-connections between the irrigation <br /> well and any other utilities. Motion seconded by Laurel Almquist. VOTE: Unanimous(3-0). <br /> NEW BUSINESS <br /> 1. Review and approval of meeting minutes: Minutes of the June 27, 2019 and July 25, 2019 Public <br /> Session were reviewed. <br /> There being no comments or discussion, Laurel Almquist moved to approve the minutes of the <br /> June 27, 2019 and July 25, 2019 Public Session. Motion seconded by Mallory Langler. VOTE: <br /> Unanimous(3-0). <br /> 2. Sign expense warrants. Expense warrants were signed. <br /> 3. Request for new Mobile Food Vendor, Kool Beans Ice Cream. Mr. Harrington commented that <br /> this request was made due to the fact that the operator was working in Mashpee without a <br /> permit. This vendor has an ice cream boat from which pre-packaged ice cream is sold. The <br /> operator was notified that a permit is required, and promptly visited the Health Department to <br /> get a permit. The application for permit and fee,ServSafe Certification,State Hawkers&Peddlers <br /> Permit, Town of Barnstable Police-issued Ice Cream Truck Permit, and Town of Barnstable Food <br /> Establishment Permit were provided. The boat has not been inspected and the menu was not <br /> provided. <br /> Chair Baumgaertel stated his concern that the owner has been operating a long time, at least <br /> since 2015, and it appears that he has continued to operate without a permit since being <br /> contacted by the Health Department. Mr. Harrington stated that the operator was not given an <br /> order to cease and desist, because he initiated the permitting process immediately after being <br /> notified. There is a generator on the boat, and it always maintains temperature. Mr. Harrington <br /> suggested that double fees be assessed, since he operated without a permit for most of the <br /> season. <br /> There being no further comments or discussion, Mallory Langler moved to approve the Mobile <br /> Food Vendor Permit for Kool Beans, with the following conditions: the operator 1) schedule an <br /> inspection of boat; 2) provide the Health Department with a copy of the menu;and 3) pay double <br /> permit fees for operating without a permit.
