Body Art Permit. No body art facility was identified on the application;therefore, a facility permit <br /> is not requested at this time. <br /> Heather Compton introduced herself for the record, indicating that the next step for her is to <br /> determine a location. Mr. Harrington stated that a doctor's office would be exempt from the <br /> regulation and does not need a facility permit. <br /> There being no further comments or discussion, Laurel Almquist moved to approve the Body Art <br /> Permit for Heather Compton with the condition that the practitioner provide the location of the <br /> facility where she will practice, if in Mashpee. Motion seconded by Brian Baumgaertel. VOTE: <br /> Unanimous(2-0). <br /> 4. Discussion of proposed "Delivery Only" Food Permit. Mr. Harrington commented that the <br /> inception of"delivery only"food carriers has reached Mashpee and a permit to operate has been <br /> requested of the Board. New companies like GrubHub, UberEats, DoorDash,etc.are transporting <br /> prepared food. The transporters are not preparing food in the vehicle or handling the ready-to- <br /> eat food, as it is pre-packaged. The 2013 Federal Food Code does require a permit for <br /> transportation of food if the facility that is delivered to is not a licensed food establishment. The <br /> citation in the Code is in the definition of a food establishment#2(A). If the Board requires this <br /> type of business to be permitted, then all the food carriers operating in the Town will have to be <br /> identified and permitted. The Code is not specific and does not state any training requirements <br /> for"delivery only". The Department of Public Health(DPH) has not sent out any guidance on this. <br /> Chair Baumgaertel asked if the Board would be permitting individual drivers or the companies <br /> they represent, and Mr. Harrington answered that they would be permitting the vehicle. He <br /> indicated that the reason we have not previously issued permits for transportation only is <br /> because, up until now, delivery has always been a service provided as part of the operation of a <br /> licensed food establishment. The transportation of food was covered under an establishment <br /> that receives, prepares and serves food. <br /> Mr. Harrington brought up another aspect to this, which is liability for the maintaining the safety <br /> of the food. The licensed facility is preparing the food,then turning it over to an unlicensed entity <br /> to deliver to an end user for consumption. If the food goes bad or is adulterated or contaminated <br /> while being transported, the food establishment should still be held responsible as they are <br /> providing the food and entrusting it to the unlicensed transporter. <br /> 5. Request for new"Delivery Only" Food Permit,Glovann Palmer—Orders We Go. <br /> The applicant, Glovann Palmer, introduced himself for the record and gave a description of the <br /> nature of his business, which originated in Falmouth. He stated that most restaurants sign an <br /> agreement and assume all responsibility for the food. Some of the restaurants are not even <br /> aware that a service has been hired to pick-up and deliver their food. Chair Baumgaertel asked if <br /> Falmouth has any permitting requirements, and Mr. Palmer answered that they do not. Mr. <br /> Harrington requested a copy of the agreement that is signed by the restaurants. <br /> There being no further comments or discussion, Laurel Almquist moved to continue discussion of <br /> the request for new "Delivery Only" Food Permit for Glovann Palmer/Orders We Go until the <br /> meeting on October 10, 2019. Motion seconded by Brian Baumgaertel. VOTE: Unanimous(2-0). <br /> 6 <br />
