*DRAFT* SELECTMEN MINUTES 11-4-2019 8 <br /> Board of Selectmen <br /> Minutes <br /> November 4, 2019 <br /> APPOINTMENTS & HEARINGS <br /> Discussion and Approval of Host.Communty Agreement for a Marijuana Cultivation/Product <br /> Manufacturing Establishment: OGCC, LLC, Jason Kabbes: <br /> The Board of Selectmen met with Jason Kabbes,primary of Ocean Grown Canna Collective <br /> (OGCC,LLC)to discuss his request to obtain a Host Community Agreement with the Town of Mashpee: <br /> Additional primaries of the business include Mashpee residents Justin and Trevor Bigwood and David <br /> Alport and Antionetta Natoli respectively from New Jersey and Ohio. Mr. Kabbes resides in Mashpee <br /> half time. His additional residence is in Rhode Island. <br /> Mr. Kabbes indicated that he desires to cultivate and process medical cannabis at the proposed location; <br /> 57 Industrial Drive, Mashpee within a 7.880 square foot(6,000 warehouse, 1,800 office) Morton <br /> Building, an existing machine business. <br /> Mr. Kabbes currently operates a dispensary in Ohio without incident. Within the project application was <br /> a letter from the Department of Commerce dated July 2, 2019 regarding the Ohio Clean Leaf, LLC. This <br /> company was issued a.certificate of operation in September 2018. There are no past or pending <br /> enforcement actions against this firm. <br /> With the approval of the final license by the Cannabis Control Commission, the OGCC will agree to <br /> make annual payments equal to 3%of gross revenue from marijuana and marijuana product sales in the <br /> first year of operation. In the second,third, fourth and fifth years of operation 3% of gross marijuana and <br /> product sales would be paid in two six month segments. <br /> A 3% local tax is applicable, and donations in the amount no less than$5,000 to a non-profit or entities <br /> approved by the Board of Selectmen would be contributed annually for the purposes of drug abuse <br /> prevention/treatment/educatiori programs. The programs shall be held in Mashpee and those <br /> communities adjacent to the Town of Mashpee. <br /> In discussing this proposal Mr. Kabbes was requested to provide letters of recommendation from <br /> businesses supporting this location. Mr. Kabbes a former PHD student and research scientist indicated <br /> through the proposed contract he has made good faith donations to support economic qualities. <br /> Town Manager Rodney C. Collins also stated that Mr. Kabbes has been extremely sincere, and has <br /> expressed a deep interest in the Mashpee community. It is the intention of Mr. Kabbes to work toward a <br /> commons goal to whatever the objectives may be. Mr. Kabbes has appeared to be open-minded and has <br /> provided the information the Town of Mashpee has requested. The applicant has complied with the <br /> mandates of the law, and the Host Community Agreement before the Board of Selectmen with its <br /> referenced general terms and conditions has been prepared by Town Counsel. <br /> With regards to the use of the existing Morton Building Mr. Kabbes indicated the building would be <br /> modified internally. <br /> The types of products intended to be produced include; Cannabis Flower and Cannabis oil (CO2 derived) <br /> and tinctures. It was explained the extract with CO2 is safer to use, with no chemicals. The licensing for <br /> the retail facility is medically inclined. <br />
