MA 02649 <br /> PUBLIC HEARING NOTICE <br /> Pursuant to Chapter 40A of Massachusetts General Law, the Mashpee <br /> Planning Board will conduct a public hearing at 8:05 P.M. on <br /> Tuesday , November 261 1985, at Town Hall, Central Road, Mashpee to <br /> see if the Town will vote to amend the Town By-Laws by adding thereto <br /> a new section 4.5.15 as follows: <br /> "Section 4 . 5 . 15 Parades , Carnivals , Fairs and Festivals <br /> No person or organization shall maintain a <br /> parade, carnival, fair, or festival in the <br /> Town of Mashpee without first having obtained <br /> a permit from the Board of Selectmen. The <br /> The Board of Selectmen shall, in each instance <br /> of application for such a permit, conduct <br /> a public hearing. Notice of said hearing <br /> shall be given by publication of the time <br /> and place thereof in a local newspaper not <br /> less than 7 days before the hearing and <br /> the expense of such publication shall be <br /> borne by the applicant. After such a hearing, <br /> the Board of Selectmen shall render a decision <br /> in writing stating the decision and the reason <br /> therefore , and shall file the decision with <br /> the Town Clerk and send a copy thereof to <br /> the applicant. In considering the application <br /> for a permit the Board of Selectmen shall <br /> take into account the general safety and <br /> wellbeing of the inhabitants of the Town, <br /> the rights of abutting property owners, and <br /> the benefit to be conferred upon the general <br /> public by the granting of the permit. Upon <br /> the filing of the application with the <br /> Board of Selectmen, the applicant shall also <br /> give notice to the Chief of Police , the Chief <br /> of the sire Department, the Board of Health <br /> and the Building Inspector, and the applicant <br /> shall submit proof to the Board of Selectmen <br /> at the hearing that notice has been duly <br /> given. The Board of Selectmen may impose <br /> such conditions as it deems appropriate for <br /> the protection of public safety and property . <br /> Any permit granted hereunder may be revoked <br /> by the Board of Selectmen for violation of <br /> any term or condition impose; b./ the permit" , <br /> or take any ott.er action relating thereto . <br /> Submitted by Richard S.
