He wanted to discuss taking some trees down on Frog's Leap Pond. It's near the entrance <br /> to New Seabury and us used for photos, fishing, boats, hockey, etc. There's a situation where a number . <br /> of trees are in the pond and leaning over. When they fall in the water they stick up. It is configured of 3 <br /> ponds and we can't access all parts of the pond. We are asking for permission to take down the dead <br /> trees in the water and those hanging over. Our plan is not to take any trees away, we would just cut <br /> them and leave off to the shore. Agent commented there may have been some miscommunication-he <br /> did have an onsite, but on a different, yet similar pond. This is a natural pond, not man-made. I don't <br /> have a problem with any work taking place, I thought this was about a different agenda item. - If the <br /> Commission finds it acceptable, we can follow this through as an administrative request but allowing the <br /> opportunity for me to get out there and see. I just want to make sure we get a look at each tree that's <br /> being requested to be removed, it requires checking it out before any authorizations. <br /> Mr. Sweet said to keep in mind the entry/exit point from where the contractor needs to work if they remove <br /> trees and material. <br /> Agent said nothing is being removed. <br /> Mr. Sweet still questions-some of these trees'are relatively large, are you just going to lay them there? <br /> Agent answered it would have to be done in such a way where it's not smothering out other'vegetation. <br /> Those are the things we would look at. <br /> Mr. Sweet said I'm sure you're going to hear from the Homeowner's Association that have walking paths <br /> out there. It's complex, I think it makes sense you work closely with Bob and some of the other members <br /> of his team so we have a proper action to take care of at the next meeting. <br /> Mr. McKay said it's a big reach for administrative action. There should be notices to the abutters, an <br /> opportunity for them to weigh in. <br /> Mr. Sweet said there could be 100 abutters, that's why it should go to the Homeowner's Association most <br /> of that land is probably in their jurisdiction. <br /> Mr. McKay said this sounds like a huge exception to normal policies and regulations to me. It sounds <br /> like an NOE not just an RDA. <br /> Mr. Beamer said there are.only about 5 homes on the pond and the pathways do not offer much of a view <br /> of the pond. We're only trying to maintain the beauty of the pond and.leave the materials there so it looks <br /> natural. <br /> Mr. McKay said it seems unfair to other people who have/will go through the procedures as usual. <br /> Mr: 'Sweet'said he would defer to the Agent's opinion. It's not clearing for anything, just taking those <br /> trees that have tipped over over the years. <br /> Agent said he just hasn't seen it yet, he was taken to Fishhook Pond which is similar, I'd just say to put it <br /> to a vote. <br /> Motion: Mr. McKay moved (with the understanding that he is opposed to this)that we recommend <br /> the Agent go forward with Administrative Action.
