Town of Mashpee <br /> 11 <br /> y 16 Great Neck Road North <br /> Mashpee, Massachusetts 02649 <br /> BOARD OF HEALTH - PUBLIC SESSION <br /> Mashpee Town Hall —Ockway Meeting Room <br /> Minutes of the Meeting of March 5, 2020 <br /> Board Members Present: Member Absent: Also Present: <br /> Brian Baumgaertel,Chair Glen Harrington, Health Agent <br /> Mallory Langler,Vice-Chair Caitlin Gardipe,Assistant Health Agent <br /> Veronica Warden,Clerk <br /> Chair Brian Baumgaertel called the meeting to order at 7:02 PM. <br /> APPOINTMENTS <br /> 7:15—22 Falmouth Road <br /> Mr. Harrington provided written comments to the Board which included details of the most recent <br /> Tobarcu Compliance Check on February :1.9, 2020, resulting in violations at 22'F51snouth`Road,The Karp; ' <br /> Chair Baumgaertel noted that there was no representative present frorn the establishment, and asked if <br /> members felt the matter should be continued. Mr. Harrington advised the Board that the owner of The <br /> Barn had been given adequate written notice of the hearing. Chair Baumgaertel summarized that this <br /> was a case,similarto other recent cases,where the establishment was cited for selling Fronto leaves,and <br /> the owners were given a "pass" on the condition that no new violations occurred within a 12-month <br /> period. In light of the new violation for sale of tobacco products to a minor, reinstatement of the earlier <br /> violations and fines was warranted,and this would be considered the second violation. Ms.Langler stated <br /> that, in this same situation at AIITown Mobil and Mashpee Shell, the Board had upheld the five-day <br /> suspension for the second violation. Mr. Harrington recommended setting the 5-day suspension for a <br /> week or two out, to allow time for the owner to file an appeal, should he choose to do so.. Chair <br /> Baumgaertel and Mr. Harrington also recommended including reinstatement of the earlier violation and <br /> fines as part of the motion. <br /> There being no further comments or discussion, Mallory Langler moved to reinstate the previous tobacco <br /> violations and fines that had been suspended, and to uphold a 5-day suspension due to the violations at <br /> The Barn. The suspension will take place March 23-27, 2020. Motion seconded by Veronica Warden. <br /> VOTE: Unanimous(3-0). <br /> OLD BUSINESS <br /> 1. Review of Compliance — Refuse Violation, Cabral Container, 81 Echo Road. Mr. Harrington <br /> commented that, at the last meeting,the Board issued a cease and desist by denying Mr. Cabral <br /> his right to haul refuse. The'pile needed to be covered and fines were issued. The Board's decision <br /> letter was hand-delivered and Mr. Cabral responded that his divorce attorney would appeal the <br /> fines. Mr. Harrington did receive a text from Mr. Cabral, which he read into the record. Mr. <br /> 1 <br />
