It was noted that applicants can request a <br /> variance to the Sanitary Code as well as any local regulations: Ms. Warden went,on record as <br /> being against allowing more than two people per bedroom. Ms. Langler was also in favor of <br /> limiting occupancy to two people per bedroom. Chair Baumgaertel clarified that he was on board <br /> with two people per bedroom,and not with the plus two, but he wanted to explore any possible = <br /> weak points in that position. He then asked if there is a definition for occupancy of a motel room, <br /> because there is a design flow of 110 gpd defined for a motel room. Ms. Langler answered that <br /> motels are based on the Sanitary Code and square footage of the room. <br /> Mr. Harrington agreed to look at how other towns have set-up their rental programs, and <br /> determine any cases in which those towns have been challenged. At the request of the Board,he <br /> will prepare a revised draft Short-Term Rental Regulation that included the occupancy calculation <br /> that limited to two people per bedroom,with a section added explaining the process to request <br /> a variance. <br /> 3. Discussion of short-term rental company contract options. Mr. Harrington commented that the <br /> Board had voted previously to go with LodgingRevs but, at this time,.the Board was.being <br /> presented with contract options. Mr. Harrington recommended the "on-going" compliance <br /> option. He informed the Board that property owners have been inquiring if they can rent their <br /> properties as they normally would prior to the initial notification and inspection. While the by- <br /> law states that the inspection must take place prior to issuance of the rental certificate,the plan <br /> is to issue temporary certificates and conduct inspections throughout the year. <br /> There being no further comments or discussion, Mallory Langler moved to approve LodgingRevs <br /> Compliance and Notification System, Option B, initial and ongoing compliance and notifications <br /> for$12,780. Motion seconded by Veronica Warden.. VOTE: Unanimous(3-0). <br /> 4. Rental property occupancy — review of floor plans. Mr. Harrington commented that in this <br /> particular property owner's inquiry,he had requested to be allowed to have an occupancy of eight <br /> (8) people in his three-bedroom home. By straight square footage in the bedrooms, Mr. <br /> Harrington stated that the property could accommodate seven (7) people, which raised the <br /> question of whether the Board wants to apply that portion of the Sanitary Code, and the <br /> calculation of the habitable space,to allow additional occupants. <br /> 5. Discussion of Santuit Pond septic inspections. Mr. Harrington informed Board members about a <br /> 37-year study that shows nitrogen has no effect on phosphorus levels in a freshwater pond. Mr. <br /> Harrington is planning to ask the Town Manager if the Town can pay to pump septic tanks around <br /> the pond, once or twice over the next two years,to reduce the amount of phosphorous coming- <br /> out of the systems. <br /> 6. Update on 100 Great Neck Road North. Mr. Harrington commented that the property owner <br /> wants to keep the laundromat part of the motel but that puts the property over 10,000 gpd; <br /> therefore, this is no longer under local Board of Health jurisdiction and is now a matter for the <br /> DEP. If the laundromat were used for residents only, it would be considered part of the flow of <br /> the residences. If it is considered industrial flow, DEP may require a tight tank. Mr. Harrington <br /> stated that,each time he has been out to the property,the systems have not been overflowing. <br /> 7. Review of proposed amendments to Food Establishment Inspection Regulation. Ms. Warden <br /> opened the discussion by asking for an explanation of the difference between a Core and a Priority <br /> violation.
