Chair Baumgaertel asked why the reserve area wasn't being placed under the driveway. Mr. Lizardi <br /> answered if the Board would be-amenable to that, it would require a Variance to the slab, a variance to <br /> the leaching drainage, and variances to each of the drywells, in place of the variance to property line. <br /> Board members agreed this was the best way to achieve compliance and to address abutter concerns. <br /> Mr. Harrington noted that abutters would still have to be notified because it is new construction and a <br /> Title V variance. <br /> Beyond the technical aspects of the discussion, Chair Baumgaertel wanted to go on record to say that <br /> there needs to be a discussion and some guidance on what to do with lots like this one,given the nitrogen <br /> issues in the area. Ms. Langler asked where Monomoscoy falls on the sewer plan, and Mr. Harrington <br /> answered that all of the waterfront properties on the south side are in the last phase. <br /> There being no further comments or discussion, Mallory Langler moved to approve the septic plans for <br /> 241 Monomoscoy Road pending the reserve area being moved into the driveway with the new variances <br /> being added, and final approval of the revised plan by the Health Agent. Motion seconded by Brian <br /> Baumgaertel. VOTE: Unanimous(270). <br /> 7:20—Show-Cause Hearing, Mashpee Wampanoag Rod &Gun <br /> Mr."Harrington commented that notice of the hearing was sent out on February 11, 2020, but our office <br /> had not received the green certified mail card back yet. The Rod&Gun Club is an all-volunteer operation, <br /> so he recommended holding off on addressing this matter to give the volunteers-a bit more time. <br /> There being no further comments or discussion; Mallory Langler moved to continue the Show-Cause <br /> Hearing for the Mashpee Wampanoag Rod & Gun Club to the next meeting. Motion.seconded by Brian <br /> Baumgaertel. VOTE: Unanimous(2-0). <br /> 7.30—Show Cause Hearing, Mashpee Village Food Pantry <br /> Mr. Harrington commented that the Mashpee Village Food Pantry is now in compliance. <br /> OLD BUSINESS <br /> 1. Review of Compliance—Refuse Violation, Cabral Container,81 Echo Road. Mr. Cabral was not <br /> in attendance at1he meeting, but Mr. Harrington read directly into the record a text he received <br /> from Mr. Cabral, stating that the pile would be removed in two weeks. Mr. Harrington <br /> recommended that the Board deny the 2020 Garbage Hauler's Permit for Cabral Container and <br /> discuss possible fines. <br /> Based on one bid received from a trash hauler, Mr. Harrington submitted a warrant article for the <br /> May Special Town Meeting, requesting $100,000 to remove/dispose of the refuse at 81 Echo <br /> Road. The Town Manager later increased that amount to$150,000. Mr. Harrington advised the <br /> Board that those funds have to be appropriated, and would not be available until after Town <br /> Meeting, assuming the request is approved. If those funds are expended to remove the trash, a <br /> lien would subsequently be placed on the property. <br /> Fines were discussed for both the refuse and the nuisance violation,and the permittee would be <br /> responsible for them. Mr. Harrington did not think those fines would automatically carry over to <br /> a new property owner but stated that, if a new owner was ordered to correct the violations and <br /> failed to do so, new fines could be imposed. .He informed the Board that Monday-Saturday are <br /> 2 <br />
