MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 8,2020 <br /> 6 Quaker Run Road: Petitioner,Frank Masci requests Variance relief from the side yard <br /> setback under§174-31 of the Zoning Bylaws to allow for construction of a shed on property <br /> located in an R-3 Zoning District, Map 83 Parcel 214, Mashpee, MA. (Owner of record: <br /> Susan Masci). (Continued from December 11, 2019 hearings, opened but not heard). <br /> Mr. Masci represented himself for the Variance relief for his shed. He read a letter dated <br /> November 10, 2019 from the builder of his home. His builder recommended a specific <br /> .location for the 16' x 26' shed because of the topography of the lot, and that the property <br /> boarders two roads. Mr. Masci also read letters of approval from his abutters. Mr. Masci <br /> said that the shed will be set on an angle, and only a corner of the shed will be within the <br /> 15 ft. setback but will still be 5 ft. from the property line. It's a heavily wooded area and <br /> he wants to keep the landscaping the same. <br /> Chairman Furbush asked what the footings will be for the shed. Charlie said that he will <br /> require a building permit. Jonathan didn't realize that sheds larger than 120 sq. ft. require <br /> a 15 ft. setback from the property line. Smaller sheds require to be setback 5 ft. <br /> Sharon read the Conservation comments into the record. Mr. Bonvie thought that the <br /> request would possibly only require determination approval by Conservation if it were <br /> placed in an area that would not require a Variance. Mr. Maintanis said that he is familiar <br /> with the property; there's a steep slope in the rear and he will need to excavate because <br /> there cannot be sono tubes out of the ground. <br /> Scott read the Board of Health comments into the record. There were no comments from <br /> the Board or audience. <br /> Mr. Bonvie made a motion that the Board issue a Variance to Frank Masci in the amount <br /> of 10 ft. from the side yard setback located at 6 Quaker Run Road to allow for construction <br /> of a shed with the following conditions; <br /> 11. The Board has determined that the applicant meets all the conditions of a Variance <br /> under Mass General Law 40A Section 10. <br /> 2.
