t...:`°""5, Town of Mashpee <br /> ,. .�s, <br /> i <br /> y 16 Great Neck Road North <br /> �Rti HULL Mashpee, Massachusetts 02649 <br /> BOARD OF HEALTH - PUBLIC SESSION <br /> Mashpee Town Hall —Waquoit Meeting Room <br /> Minutes of the Meeting of December 19, 2019 <br /> Board Members Present: Member Absent: Also Present: <br /> Brian Baumgaertel,Chair Glen Harrington; Health Agent <br /> Mallory Langler,Vice-Chair <br /> Veronica Warden,Clerk <br /> Chair Brian Baumgaertel called the meeting to order at 7:00,PM. <br /> APPOINTMENTS <br /> 7:15—Cabral Container,81 Echo Road <br /> Mr. Harrington commented that, in August, the Fire Department notified the Board of Health that a pile <br /> of solid waste had been accumulating at 81 Echo Road where Ron's Excavating and Cabral's Container <br /> Service operates. Cabral's Container Service is operated and owned by.Manny Cabral. Mr. Harrington <br /> stated he had spoken with Mr. Cabral's son,Taylor,on a septic job.Jaylor explained that his father was <br /> going through a difficult time. Mr. Harrington subsequently reached out to Mr. Cabral,who promised to <br /> remove the solid waste pile as soon as possible, indicating that he had a new relationship with New <br /> England Recycling and they would be taking the waste. Mr. Cabral did provide several weight slips from <br /> September for waste that was disposed of by New England Recycling. No other weight slips were <br /> provided, and Mr. Harrington continued to communicate with Mr. Cabral, who continued to promise <br /> some•results but failed to follow through. Two individuals had approached Mr.Harrington recently stating <br /> they witnessed Mr. Cabral bringing in more waste. The first order letter was sent on October 15, 2019, <br /> requiring that the solid waste be removed within 30 days. When no corrective action was taken,a second <br /> letter was sent on November A, 2019, notifying Mr. Cabral of this show-cause hearing. Mr. Cabral was <br /> unavailable to attend the meeting and,therefore,could not.speak in his own defense. <br /> Mr. Harrington informed the Board that Mr. Cabral has been a respected septic installer for a long time, <br /> but this is a serious issue that cannot be overlooked. There are no residences in the Immediate area and . <br /> the nature of the solid waste is primarily demolition debris, but proper disposal of the trash is a condition <br /> of the Garbage Hauler's•Permit that was issued by the Board of Health. Material has been accumulating <br /> since late August and removal would cost$60-80K. Ms. Langler stated that construction debris is not an <br /> emergent health hazard and, in her opinion,this has not reached the point where the Town should pay <br /> for removal of debris. Mr. Harrington added that DEP is concerned the debris could contain asbestos <br /> .and/or lead paint, so they are anxious to get this addressed. Mr. Harrington also advised the Board.that <br /> Ron Gangemi,who previously owned the property,still holds the note on land;therefore,a lien would fall <br /> back on.him and not on Mr. Cabral. <br />
