at that address. The business maintained a presence on Google and Facebook. The public <br /> Facebook page showed a built-out basement area with one barbershop chair at the property. A <br /> post on the Facebook page stated the address of the business had relocated to Mashpee around <br /> November of 2019. Multiple photos and screenshots were taken of the Facebook page,its posts, <br /> and the services provided. The Health Agent, Glen Harrington, sent an email to the business to <br /> serve as a "cease and desist" order. Effective March 24, 2020, the Baker-Polito administration <br /> issued an order closing all non-essential businesses throughout the Commonwealth, which <br /> included all salons and barbershops. Furthermore, the residence has a septic system permitted <br /> for three(3)bedrooms,and the home has three bedrooms.Therefore,the septic system does not <br /> have the required 100 gallons per day of additional design flow required for the barbershop chair, <br /> per Title V. <br /> On April 8, 2020, Mr. Harrington and Ms.Gardipe went to the property to inspect the barbershop <br /> and speak to the homeowner. The homeowner, Marjorie Moriarty, answered the door and did <br /> not permit access. Later that evening, Ms. Moriarty responded to the "cease and desist" email <br /> from Mr. Harrington, stating that she had spoken to her attorney and would like to schedule a <br /> time for an inspection with the Board of Health. <br /> On April 16, 2020, Mr. Harrington and Ms. Gardipe inspected the basement of 7 Webquish Lane, <br /> Ms. Moriarty was present, as well as her father. Ms. Moriarty stated that the barbershop was <br /> closed per the order regarding non-essential businesses. The premises did not have a sink, <br /> although there did appear to be a sink in one of the screenshots taken from the Facebook page. <br /> The barbershop chair was still in the room.There were no chemicals,oils,or hair coloring products <br /> observed. Ms. Moriarty stated that-she never uses any chemicals and only works with men's hair. <br /> Regarding the basement build-out, Ms. Moriarty stated that the basement was finished when she <br /> bought the house in October of 2019, which was verified in photos on the real estate website <br /> Zillow. Mr. Harrington stated that the business cannot operate again unless the septic system is <br /> upgraded to allow for the additional design flow, per Title V. <br /> Ms.Warden asked if Ms.Moriarty was licensed with the Division of Cosmetology,and Ms.Gardipe <br /> answered in the affirmative. Since she does not have the septic capacityto support a barbershop, <br /> Board members agreed that Ms. Moriarty would have to either upgrade the system, remove a <br /> bedroom, or take other action to bring it into compliance with Title V. The house is zoned RS, <br /> according to the Building Inspector, which means it would have to be permitted under a home <br /> occupation prior to any septic approvals. .Ms. Moriarty was advised to contact the ZBA. Mr. <br /> Harrington stated that the owner has complied with everything the Health Agents requested, so <br /> no fines were issued, but the barber chair does need to be removed. <br /> Ms. Warden went on record as stating that there should be a letter to the owner on file in case <br /> Health Agents are ever called out to the property again,and Mr.Harrington stated that one would <br /> be prepared. <br /> Chair Baumgaertel opened the discussion to public comments through remote call-in, but none <br /> was presented. <br /> There be no further comments or discussion,Veronica Warden moved that a Health Agent would <br /> forward a letter to the owner of 7 Webquish Lane,stating that the barbershop must remain closed <br /> until all local ZBA regulations and Title V requirements are met,and that the barbershop chair be <br /> removed from dwelling. Motion seconded by Mallory Langler. Roll call vote: Brian Baumgaertel <br /> (yes);Veronica Warden (yes);Mallory Langler(yes). VOTE: Unanimous(3-0). <br /> 3 <br />
