MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 22,2020 <br /> It was approved by the Conservation Commission, and meets the all the required setbacks <br /> from the bylaws. The Board of Health mentioned that they consider the loft area to be a <br /> bedroom. <br /> Mr.Kirrane suggested that the Board could issue a condition to satisfy the Board of Health <br /> upon granting relief that the space either be altered or eliminated so it does not qualify as <br /> a bedroom. He asked for questions from the Board. <br /> Mr. Furbush asked if the cottage has its own septic system. Mr. Kirrane said no; it's <br /> connected to,the septic system of the main residence. The hand-drawn plan depicted what <br /> looked like a leaching field, and that might have raised the question with the Board of <br /> Health if it was capable of accommodating two bedrooms. The Board of Health will only <br /> allow four bedrooms, and the house currently has three bedrooms. Mr. Kirrane said that <br /> the floor plan shows a loft and living space below with a bedroom. It would exceed the <br /> septic capacity if there were two bedrooms in this cottage structure. Mr. Furbush wanted <br /> to confirm that this cottage was not classified as an accessory apartment because there is <br /> currently only one bedroom. Mr. Kirrane said that is correct. He said this is simply a pre- <br /> existing non;conforming structure that is being razed and replaced,to become more livable <br /> compared to its current condition. Mr. Kirrane said currently there is a bathroom and one <br /> bedroom in this cottage. He also provided interior photos of the cottage showing its current <br /> condition. <br /> Mr. Bonvie asked Charlie if he had seen the structure. Does he believe that this property is <br /> a habitable residence? Charlie said that the cottage can be considered a one or two family <br /> residence. Yes, he considered this a residence. <br /> Scott had no issues. Sharon believes that it needs to be torn down. Charlie mentioned to <br /> Mr. KirraneAhat it looked like a demolition has started, and this requires a demo permit. <br /> There's a list of requirements from the other departments,and they can request that through <br /> the Building Department. <br /> Mr. Bonvie,asked if the lot coverage was getting better or not changing. Mr. Kirrane said <br /> that the lot is currently 43,000 sq. ft., and the difference between what is there now is 762 <br /> sq. ft., reducing the size to 747 sq. ft. Given the size of the lot there is no issue. <br /> Charlie asked if there is a proposed deck for the cottage. Mr. Kirrane said the plan shows <br /> a proposed brick patio to be replaced by concrete. <br /> George had no comments. Bill had no comments. <br /> Sharon read:the Board of Health comments into the record, and Conservation approved the <br /> project. <br /> There were no more comments from the Board. There were no phone calls from abutters. <br /> 3 <br />
