MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
MAY 13,2020
In addition, there were a number of other submissions between the first session and this
session. The Highland residents are very hopeful that the Board will maintain the 50 ft.
buffer. Mr. Senie hired a Civil Engineer who prepared a plan showing the drainage area
moved to preserve of the 50 ft. buffer.
He said that what Ron mentioned regarding the 25 ft, is better than 19 ft. to support the
landscaping is a terrific development, but wanted the Board to keep in mind whatever
action the Board takes could affect other locations along the Southern boundaries of the
industrial park.
Jonathan said that in his opinion the additional fence is a little excessive, and does not
believe it is.warranted. Jonathan polled the Board;Bill agreed,Jim agreed, Sharon agreed,
and Ron agreed. Jonathan said that he believes that the 19 ft, setback is reasonable. He
polled the members; Bill agreed, Jim agreed, Sharon' agreed, and Ron agreed. Jonathan
wanted the Board's opinion on the hours of operation. Ron wanted comments from each
member. The Board reviewed the hours of operation that were given to Clipper
Landscaping which were 6:15 am to 7:15 pm(no mention days of the week).
Jonathan wanted Attorney Kirrane to discuss what type of businesses will be going into the
building.Mr.Kirrane said contractors;there are five bays.As he mentioned at the previous
meeting,he agreed to remove the wording that the Board requested regarding"other uses".
Jonathan does agree that shutting down a business on a Sunday is not right, and would not
have a problem with the hours as mentioned in Clipper Landscaping.He polled the Board;
Bill agreed. Jonathan asked Charlie if any neighbors of Clipper Landscaping have
complained. Charlie said that he remembers there was a complaint over the lighting. He
does not believe there was a call regarding the hours.
Jonathan polled the members; Jim agreed, going in the right direction, Jim Reiffarth, no
comment, George,no comment. Attorney Seriie does not believe those hours are adequate.
Mr. Kirrane asked Charlie what.the bylaws said about operating hours. Charlie said that
the bylaws are weak, and if there's a complaint from someone,he advises them to call the
police. Generally, a contractor starts work at 7:00 am, and therefore it is not an
unreasonable request to set start time of 6:15 am.
Jonathan mentioned that the industrial park was built long before the residential area, and
wanted to hear suggestions from the Board members regarding an early start time. Mr.
Reiffarth suggested 7:00 am,Mr.Blaisdell agreed with 7:00 am,Mr.Bonvie recommended
a 6:45 am start time.
Mr. Kirrane asked if there were hour restrictions on the adjacent property. Jonathan said
he was not involved with that decision. Jonathan mentioned the hours being 6:30 am to
6:30 pm, and polled the members;Bill,Ron,Jim,Jim Reiffarth, and George all agreed.
i
Mr. Kirrane mentioned that the Water Company works around the clock.
