MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 8,2020 <br /> Mr. Mills spoke with the Selectmen's office and got a copy of the liquor license that was <br /> turned in on May 2019. Mr. Mills said the applicant is not seeking a Special Permit. He is <br /> seeking a Written Finding that is not more detrimental than the previous use.Mr.Mills said <br /> he agrees with the expiration date of the Special Permit. <br /> Sharon mentioned that the discussion regarding the sunset statement at Plan Review refers <br /> to the retail space, not this application. <br /> Mr. Mills said that the discussion should only be regarding the requested proposal brought <br /> before the Board. There is no Special Permit. Mr. Mills said that his client Mr. Marichal, <br /> the property owner will gladly cooperate on what he intends to do, and is in the process of <br /> working through the requirements for the property. <br /> Mr. Marichal said he spoke at the Plan Review meeting. His intensions are to fix the <br /> property and septic system by working with BSC Group for the engineering. He is also <br /> working with Sage Environmental at the same time because the septic system is very large. <br /> There was a ground water test and a hydro ecological evaluation done, and both companies <br /> are in the process of working with him on the system to upgrade the property drainage <br /> issues. <br /> Charlie said to read the motion because these issues are discussed in the motion. <br /> Mr. Blaisdell asked the applicants if they had any issues conditioning the motion made by <br /> the Plan Review committee. <br /> Mr. Mills said that the Petitioner doesn't have any control over what the property owner's <br /> responsibilities are for the property. <br /> The Board had a discussion regarding the issues requested by the Plan Review committee <br /> for the property owner, and was not certain if they could condition the requested <br /> enhancements of the site the responsibility of the Petitioner. <br /> Charlie said that the Petitioner cannot hold these conditions of the property owner. <br /> Mr. Reiffarth said that owner of the property is in violation allowing runoff onto the Town <br /> road and it's up to Catherine to deal with the owner of the property. <br /> Attorney Mills reiterated that the issues discussed by Catherine Laurent and Glen <br /> Harrington are being addressed with the assistance of Sage Engineering and BSC Group. <br /> If the Board conditions these issues for the Petitioner, it would be a denial of the Written <br /> Finding. <br /> 7 <br />
