MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 8,2020 <br /> Mr. Goldstein voiced his opinion as one member, that Mr. Marichal made a larger <br /> investment and is trying to improve the property over time. Mr. Abreu will be running a <br /> business that is good for the Town, and as Mr. Mills said it is not the responsibility of the <br /> business owner to deal with issues of the property owner. <br /> Sharon read the Board of Health comments into the record;"Please accept the motion from <br /> the 7 JUL 2020 Plan Review Committee as the BOH comments of record." <br /> Charlie said he cannot speak for the Board of Health but the inspectional services will have <br /> to approve the business before issuing a building permit. <br /> Mr. Blaisdell does not believe the lessee has anything to do with the issues of the property <br /> owner. <br /> Mr. Gould agrees that it's not the business owner's responsibility to be accountable for Mr. <br /> Marichal's issues with the Board of Health. <br /> Jonathan polled the Board members asking if they would prefer to consult with Town <br /> Counsel. Scott said he would like to move forward, Bill agreed to move forward, Jim <br /> Reiffarth agreed to move forward,Mr. Gould agreed, and Sharon agreed to move forward. <br /> Mr. Goldstein made a motion to approve 100 Great Neck Road North: Petitioner, Fausto <br /> Abreu d/b/a Cape Cod Appliance Liquidators requests a Written Finding under §174-17 of <br /> the Zoning Bylaws to change a pre-existing, non-conforming use from a strip <br /> club/bar/restaurant to an appliance sales and showroom occupying 3,000 sq.ft.on property <br /> located in an R-5 Zoning District,Map 45 Parcel 3,Mashpee,MA. Owner of Record: Juan <br /> Marichal, Trustee of the River Bend Village Trust,with the following conditions; <br /> • The Board has determined that the applicant meets all the conditions of a <br /> Written Finding under Mass General Law 40A Section 6. <br /> • Retail use sales of appliances within the 3,000 sq. ft. of the building. <br /> • A Parking Plan be prepared and submitted to the Building Dept. <br /> • Any work to the exterior within 200 ft. of the Riverfront requires <br /> Conservation's permission and review. <br /> • Any water runoff from the property onto Great Neck Rd.North be evaluated as <br /> part of the septic project and improved as part of the septic project. <br /> • The interior sprinkler design or changes be signed off. <br /> • An interior design plan be provided to the Building and Fire Departments. <br /> • Hours of business operation are Monday through Saturday; 10:00 am to 6:30 <br /> pm. <br /> • Sign permit application required for Design Review. <br /> • Board of Health approval. <br /> • Consult with the Building Department regarding any future changes to the <br /> building as of the Plan Review decision. <br /> • Septic and water runoff issues do not affect the change of use. <br /> 8 <br />
