Review of proposed revisions to BOH Short-Term Rental Regulation. Mr.Harrington commented
that, in the process of setting the fees for the short term rentals, the Selectmen approved a
different fee schedule for multi-unit rental properties. Essentially, Mashpee Commons and the
timeshares would be inspected at a maximum of one-third of their units each year, with all units
to be inspected over each three-year term. Per Town Counsel's opinion, the inspection fee can
only be charged when a service is rendered. The total inspection fee collected annually for multi-
unit properties would be for one third of the total units at $75/unit. The annual
registration/certificate fee would be$25 per rental property, not per unit. In order to update and
revise the Rental Regulation to reflect these fees,Sections C&D had to be added. A re-inspection
fee has also been added. Ms.Warden requested that Paragraph 7A be changed so as not to limit
the entities that are authorized to accompany the Health Agent on inspections. Mr. Harrington
stated that the Sanitary Code does not put any restriction on that; however, he would revise the
regulation to add an "e.g." before listing the other inspectional services. Chair Baumgaertel saw
no issues with the changes.
There being no comments or revisions,Veronica Warden moved to approve the Mashpee Board
of Health Rental Regulation as amended at the May 21,2020 meeting.
