6 <br /> Board of Selectmen <br /> Minutes <br /> May 4, 2020 <br /> OLD BUSINESS <br /> Status Update on Illegal Dumping at 81 Echo Road—Condition and Action Taken: <br /> Health Agent Glen Harrington: <br /> The Board of Selectmen received an update on the status of the illegal dumping at the 81 Echo <br /> Road site and recommended course of action by Glenn Harrington, Board of Health Agent. <br /> The Board of Health issued notice of violation to Manuel Cabral, owner of Cabral's Container <br /> Service in October and little has been done to rectify the health hazard and public nuisance. <br /> There have been reports the operator may have been adding late night additions of solid waste to <br /> the pile approximately 1300 cubic yards weighing 300 tons over several months but it is difficult to <br /> determine. <br /> The Board of Selectmen conveyed deep concern to the Board of Health's degree of non- <br /> enforcement. There has been little effort to verify the dumping that has been occurring since <br /> October 2019 with nighttime activities that may have started since February. <br /> If there is activity at the site, the contractor has thus violated the stop work order. <br /> Mr. Harrington indicated that today he has sought legal advice from Town Counsel and last <br /> Wednesday he has sought assistance from the Police Department to obtain night controls. The <br /> Board of Selectmen requested the cease and desist area be officially taped-off. <br /> There is an article on the May Town Meeting warrant to fund the removal of the waste, and the <br /> Town is expected to place a lien on the property to recoup the cost. <br /> Town Manager Rodney C. Collins indicated he would consult Town Counsel and work with the <br /> Board of Health and a member of the Board of Selectmen to complete the requirements to issue a <br /> Nuisance Abatement to Mr. Cabral to move forward to resolve this issue. <br /> Manuel Cabral maintains ownership of the subject property, the site of the illegal dumping. <br /> Adjacent properties at the 81 Echo Road site are owned by Gangemi Trust, Ronald Gangemi. <br />
