MASIIPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> November 18,2020 <br /> Ilana commented that this is simply to bring the Board back to the burden of proof that is <br /> required tinder the State regulations because you cannot have rules that are inconsistent <br /> with the State rules. <br /> Jonathan said that he read most of the comments submitted by Town Counsel to the Board. <br /> He said that there are other Town Department comments that have other concerns, and <br /> especially the concerns Nvith the condo association next door. <br /> Cory Fellows said that he will provide general comment and will provide written responses <br /> in a comprehensive way to address all the comments heard. They are not privy to the <br /> comments that what the police department was asked to respond to. The proximity to the <br /> existing property, and the access to the project location. He said they have a lot of <br /> experience being good neighbors and successfully developed and managed properties in <br /> much more dense settings than this area. He knows that the burden of proof is on the <br /> applicant, and will follow through and consider all appropriate buffering and safety <br /> measures since they mct with folks from the Town. They will follow up with a more <br /> detailed response to all comments. <br /> Jonathan said he asked Mashpee Police to provide comments on the letter that was received <br /> by South Cape Resort and Club, but has not received their comments as of this date. <br /> Jim Gould asked if the road going through South Cape Resort a driveway, a public road, <br /> or a paved street, or is the access through another private piece of land that is indicated. <br /> Ilana said that this lot is a subdivision right of way that was approved years ago and a <br /> portion of it was constructcd during the existing development. The present project will <br /> continue along within the approval of that subdivision way. <br /> Roseleen Cassidy, Manager of South Cape Resort was on the meeting, and she has <br /> concerns that she provided in a letter to the Board. <br /> Jonathan polled the mennbers for other comments. Bill likes the project and as long as the <br /> applicant addresses some of the concerns that were raised, this application can move <br /> forward and continue to a new night. <br /> Charlie Rowley asked if the Board approved his peer review. Jonathan asked for a motion <br /> for Board Approval. Scott made a motion to allow Charlie Rowley to continue his review <br /> as the letter he provided on October 20, 2020, and that the applicant will provide a check <br /> in the amount of $2,520 made out to the Town of Mashpee. Bill seconded, yes, Jim <br /> Reiffarth, yes, Jim Gould, yes, Scott, yes, and Jonathan, yes. All were in favor. <br /> Charlie requested Brian Kuchar for a full set of the plans. <br /> 14 <br />
