MOTION: Ms. Waygan made a motion to approve, with the condition that the plan <br /> provided be stamped by the Land Surveyor and move forward with a written decision at <br /> the next meeting. Mr. Fulone seconded the motion. All voted unanimously. <br /> NEW BUSINESS <br /> Request for Release of Covenant, 12 Cypress Circle, Assessors Map 21-23-Mr. <br /> Lehrer reported that the property owner had initially requested a release in September 2018. <br /> Release of the Covenant would require improvements to areas of the roadway, due to the <br /> development being left unfinished by the developer. Initially, the lot was intended as shared <br /> open space and green area, but not actively used, so was then sold as a buildable lot. Mr. <br /> Rowley had inspected both Fox Hill and Cypress Circle at the time, and provided his report to <br /> the property owner. Since then, Town Meeting authorized funds to purchase the parcel for <br /> affordable housing and Mr. Lehrer has been working with the owner to address the matter of the <br /> Covenant, but the owner has been unable to provide security. Mr. Lehrer reached out to Town <br /> Counsel for his opinion and was now proposing to the Board to approve the Release, and since <br /> the Town would be the buyer of the lot for affordable housing, draft an RFP to require that the <br /> developer make the necessary improvements to a section of the roadway, as required by the <br /> Planning Board. Town Counsel would hold the release until the Town tools control of the <br /> property. Letter of Interests in the property have been received from HAC and Habitat for <br /> Humanity, both of whom were aware of the necessary improvements. Mr. Balzarini liked the <br /> proposal. Mr. Callahan inquired about how quickly affordable housing could be developed at the <br /> site and Mr. Lehrer responded that it was his belief that a developer could be identified within a <br /> year. <br /> MOTION: Ms. Waygan made a motion to release the lot pursuant to the lot being sold to <br /> the Town of Mashpee for affordable housing development and that the Covenant is held by <br /> Town Counsel until the time of closing. Mr. Balzarini seconded the motion. All voted <br /> unanimously. <br /> Planning Board members signed the Release. <br /> Sign Signatory Page for Barnstable Registry of Deeds-Planning Board members <br /> signed the Signatory Page. <br /> OLD BUSINESS <br /> Discussion of Process for Hiring New Consulting Engineer-The Chair suggested that a <br /> small group, to include the Chair, Mr. Fulone, Mr. Lehrer and Mr. Rowley, to create an RFP for <br /> the hiring of a new Town Consulting Engineer. Once applications received were reviewed by <br /> the group, a final review of final candidates would be considered by the Planning Board. Mr. <br /> Balzarini inquired about rate of pay and Mr. Lehrer responded that Mr. Rowley had <br /> recommended a process. Mr. Rowley noted that a budget had been previously used to make <br /> payments, and recommended sending plans to the Consulting Engineer for a cost estimate for <br /> plan review and inspections, which would then be forwarded to the applicant, who would then <br /> make payment to be held in a 53G account to make payment to the Consulting Engineer. Mr. <br /> Rowley recommended considering the type of work the Board would be seeking, adding that a <br /> regulation was already in place in the Zoning Bylaw and Subdivision Control.
