The town consented e <br /> y p e tdtoa <br /> which would turn the money over to the association <br /> to permit its use for other purposes. <br /> Russell Peters appealed to the Appellate Tax Board the <br /> decision of the Assessors refusing to abate his taxes. The <br /> decision of the Assessors was upheld by the Appellate Tax <br /> Board. <br /> A petition brought by Henry A. White for damages as <br /> a result of the layout and taking by the town of approxi- <br /> mately 21,000 square feet for Great Neck Road was on the <br /> dist for hearing in Barnstable Superior Court and was set- <br /> tled before hearing for the amount of $2,400. <br /> Monogram Sanitation Systems, a company which fur- <br /> nished portable toilets for the Avant Museum, brought suit <br /> against the town. The town alleges that the structures fur- <br /> nished were not of good quality and were unsightly and <br /> questions the amount of the bill. The plaintiff required the <br /> town to answer written interrogatories. This case is still <br /> pending. <br /> Another petition for damages against the town for a <br /> j taking of approximately 31,200 square feet for the Great <br /> Neck Road layout, brought by Paulino Rodrigues in Barn- <br /> stable Superior Court, was settled before trial for $900. <br /> Four or five cases involving minor damage by autoists <br /> I to town-owned property were settled for the amount of the <br /> damage in varying amounts. <br /> Town counsel represented the town and former Fire <br /> Chief Warren Hicks as a result of an incident that took <br /> place at the fire station at which time there was injury to <br /> a third person and possible liability to the town. A criminal <br /> complaint against the Chief was dismissed and releases ob- <br /> tained protecting the town. <br /> A.land damage case brought by a property owner by the <br /> name of Shenker as a result of the taking for Great Neck <br /> Road is still pending in Barnstable Superior Court. <br /> Another land damage case brought by William R. Yundt <br /> and Lucie A. Yundt as a result of the taking for Great Neck <br /> Road was not pressed by the plaintiffs, and a nonsuit was <br /> entered. <br /> Town counsel examined the collective bargaining agree- <br /> ment entered into with the Police Association as to legal <br /> form. <br /> I,, <br />
