Town of Mashpee <br />16 Great JVeck Poad Arorth <br />Washpee, Massachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />Decision for a Variance <br />RE: Mashpee Realty Investors, LLC 19 Sand Dollar Lane <br />Owner: Stanley -Evans Realty Trust Map 105/91 Parcel 51 <br />V-05-19 <br />A Petition was filed on January 1 1,2005 for a Variance from Section 174-31 of the <br />Zoning By-laws for permission to vary the setback requirements in order to build a new <br />dwelling on property located in an R-3 zoning district at 19 Sand Dollar Lane (Map <br />105/91 Parcel 51) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the "['own of Mashpee, on January 14, 2005 and <br />January 21, 2005, a copy of which is attached hereto and made a part hereof. <br />• A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, February 2, 2005 and continued until February 23, 3005, at which time the <br />following members of the Zoning Board of Appeals were present and acting throughout: <br />Robert Nelson, Zella Elizenberry, Frederick Borgeson and Richard Guerrera. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of' Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. Timothy Luff of Achi-Tect Associates represented the applicant at both <br />hearings. During the initial hearing Mr. Luff approached the Board with a request for a <br />special permit in order to demolish the existing structure and rebuild a new structure, and <br />a variance request for lot coverage relief as well as setback relief. The Board <br />immediately told Mr. Luff to downsize the proposed dwelling and keep it under 20% of <br />the lot. They will not be issuing any lot coverage variances except in an extreme <br />situation and they do not consider this as such. After reviewing the plans further the <br />Board suggest that they ask for a continuance and come back. During the hearing on <br />0 <br />February 23, 2005 Mr. Luff presented the Board with plans that show the proposed house <br />
