Mashpee Zoning Mashpee Realty Investors, LLC <br />Board of Appeals Owner: Stanley -Evans Realty Trust <br />2 V-05-19 <br />• reduced to comply with their request of 20% lot coverage. They are asking for setback <br />relief only for the variance. The Board feels this has been greatly improved and moves to <br />grant the variances. <br />GENERAL FINDINGS <br />1. that the subject property is located at 19 Sand Dollar Lane and contains <br />10,080 square feet. <br />VARIANCE CRITERIA <br />Section 10 of Chapter 40A requires that the permit granting authority determine <br />that there are circumstances relating to the shape and topography which affect this lot and <br />not the district in which it is located and that a literal enforcement of the By-laws would <br />involve hardship to the petitioner. <br />SPECIFIC FINDINGS <br />1. that a literal enforcement of the By-laws would involve hardship to the <br />Petitioner. <br />• 2. that relief may be granted without detriment to the public good. <br />3. that relief may be granted without derogating from the intent or purpose of the <br />By-laws. <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br />applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br />made and seconded, the Zoning Board of Appeals voted unanimously on February 23, <br />2005 to grant the following Variances: <br />✓ A 10 -foot variance from Sand Dollar Lane <br />✓ A 4 -foot variance on the northerly side <br />✓ A 5 -foot variance on the southerly side <br />These variances are conditioned on compliance with the proposed site plan from <br />Falmouth Engineering of Falmouth, MA, dated January 18, 2005, revised February 2, <br />2005 and revised February 9, 2005 as prepared for Remodeling Plus, Inc., Project No. <br />04197, CAD File Name 04197BRPI, and architect plans from Archi-Tech Associates <br />• Archtectural Design, Inc. of COWit, MA, dated February 9, 2005: File No. 0502. <br />
