• <br />0 <br />Mashpee Zoning <br />Board of Appeals Nicholas Ruocco, Jr. <br />Four Sons Realty Trust <br />2 SP -05-16 <br />impact his property and the surrounding properties and feels that the proposed dwelling <br />will exacerbate the drainage problem. The Board reviews the comments and discusses <br />them with Mr. Slavinsky. Mr. Ruocco speaks about the drainage matter. This was <br />apparently discussed year after year in the Association Meetings and they are aware of <br />the situation and will be attending to the issue at some point soon. The Board would like <br />to impose that dry wells be added to the house for additional solution to any drainage <br />problems they may have. The Board moves to grant the Special Permit. <br />GENERAL FINDINGS <br />1. that the subject lot is located at 2 Pine Avenue and contains 6,761 square feet. <br />SPECIAL PERMIT CRITERIA <br />Code of the Town of Mashpee § 174-20 states: "Rebuilding of destroyed or <br />damaged non -conforming structure. Any non -conforming building or structure destroyed <br />or damaged by fire, flood lightning, wind or otherwise may be rebuilt, subject to approval <br />of the Board of Appeals subject to the same conditions as set forth in § 174-24 of this <br />chapter." <br />SPECIFIC FINDINGS <br />Per § 174-24 of the Zoning By-laws, the Board determined that the proposed use <br />or development: <br />1. will not cause excessive demand on community facilities. <br />2. will not destroy or disrupt any species listed as rare, endangered or threatened <br />by the Massachusetts Natural Heritage Program or any known historic or <br />archaeologic site. <br />I will properly dispose of stumps, construction debris, hazardous materials and <br />other waste. <br />4. will not cause excessive erosion or cause increased runoff onto neighboring <br />properties or into any natural river, stream, pond or water body and will not <br />otherwise be detrimental to the town or the area and will install drywells for <br />drainage. <br />0 5. will be an improvement with installation of anew Title V septic system. <br />
