For everyone. Mr. Sweet asked if they are working with Catherine at DPW, Mr. Lizardi confirmed
that they are.
Agent said this should also issue with a condition of lawn standards.
Motion: Mr. Smith moved to close and issue with a condition of Board of Health approval
and that lawn standards are compliant, seconded by Mr. McKay.
Vote: 4-0 unanimous.
6:21 John E. & Nicole D. Bartlett, 28 Sampsons Mill Road. Certificate of Compliance 43-2946. COC
6:24 BDG Realty LLC, 440 Nathan Ellis Highway. Reissue Certificate of Compliance 43-2189. COC
6:27 Robert W. & Susan M. Hughes, 2 Shore Drive. Certificate of Compliance 43-2919. COC
6:30 Brendan M. & Courtney Coughlin, 4 Summersea Road. Extension 43-2902. EXT
NOI — Notice of Intent
RDA — Request for Determination of Applicability
PRE/POST-HEARING AGENDA:
• Signatures: Willowbend Enforcement Order/violation
Agent explained the violation of 18, possibly more, large diameter trees were cut and
removed. Willowbend was notified right away, it's a very serious violation. Willowbend was
trying to increase sunlighting on this particular green and said their contractor was unaware
of jurisdiction. This crew was either thoroughly uninformed of the Wetlands Protection Act
or just did it anyway. Mr. McKay asked if we are going to issue fines, and if so to both the
contractor and Willowbend? Agent said it's a good idea, we'd want to send a strong
message here.
Motion: Mr. Smith moved to authorize the Conservation Agent to assess maximum
fines to both Willowbend and the contractor. Seconded by Mr. McKay.
Vote: 4-0 unanimous
• Vote to Authorize: Santuit Pond bog flooding to reduce phosphorous on Santuit Pond
We would have to go through a permitting process, we're just waiting to hear back if we still
have a valid permit. If not, we'll go through the motions through the state Wetland Protection
Act. Agent asked for a vote, Mr. Smith asked if it's a conflict of interest because he's a
representative of CPC, it was decided to hold off until the next meeting and we'll find out
just to be sure.
• Update: NRCS assessment of Santuit Pond Fish ladder
Agent said it was a very thorough explanation of what's wrong with the ladder and an
endorsement of an alternative that would essentially make some amendments to the
existing ladder to lengthen and deepen the pools and construct a separate spillway and a
separate ladder for eels.
• Signatures: 424 Whitings Road to accept transfer of deed (land to be conveyed to
Conservation Commission)
• ADDITIONAL TOPICS:
(This space is reserved for topics that the Chairman did not reasonably anticipate would be
discussed).
