6:12 NJCJ LLC, 21 Metacomet Road. Proposed Amendment of Order of Conditions 43-2964 to AOOC
install an additional pile and reconfigure previously approved piles to allow for addition of a boat
lift.
Michael Borselli from Falmouth Engineering represented the owner Jim Whitney (present).
They presented the plans and addressed concerns from a letter written by the Shellfish
Constable, Ashley Fisher (present). Mr. Sweet asked where the project stands right now, Mr.
Borselli said Chapter 91 license was issued 2 weeks ago, nothing has been done yet. The
Assistant Agent wanted to reiterate the regulation regarding the Shellfish Constable. Ashley
Fisher expressed her concerns about additional piles, inaccuracies on the current plan, and the
potential adverse effects. Mr. Cook asked how many piles the original plan had, Mr. Borselli
answered 2. He acknowledged that the plans being shown contain errors. The Commissioners
discussed various aspects of the lift and boat. Mr. Whitney answered more questions about the
size of the boat and water depth. Mrs. Fisher said her issue with the lift itself is that you can't
remove the entire lift. It will impact recreational shellfishing. Mr. Whitney disagreed. The
discussion went on further about depth and structure. Mr. McKay brought up concerns about
what was previously approved vs. what is being presented now. The Assistant Agent read
comments from the Harbormaster. The Commissioners discussed further. Mr. Sweet said his
concern is the bottoming out of the boat. Mr. Cook and Mr. McKay agreed. Mr. McKay went
on to stress the importance of shellfish in Mashpee. Mr. Borselli and Mr. Whitney agreed to put
together more accurate plans to bring back to the commission.
Motion: Mr. McKay moved to continue on 3126120 at 6:OOpm.
