constraint, when they bring in the materials for the dock work. If not, they'd need permission
from the abutter. Agent asked if they'd be using a mini excavator, Mr. Lizardi said either that
or by hand. Agent suggested to add a condition when the access is established to make that
known.
Motion: Mr. Smith moved to approve the AOOC with the requirement that access be
approved by Conservation. Mr. Dalton seconded.
Vote: 5-0
6:30 Jason E. &Jamie C. Sobel, Trustees, 196 Captains Row. Certificate of Compliance COC
43-2960.
6:33 Town of Mashpee, 491 Great Oak Road. Certificate of Compliance 43-2799. COC
RDA — Request for Determination of Applicability
NOI — Notice of Intent
PRE/POST-HEARING AGENDA:
• Update: Upper Quashnet 1/27/2020 kick off meeting recap, minutes review, video
Agent recapped the meeting. It went very well, about 15 attendees. Great presentations. This will
be a very well designed phase project by Horsely Witten. The first two phases are mostly about data
collections. Air Force is continuing to track data on PFAS/PFOS contamination in the area. Primary
goals are the fish and restoration of cold water habitat. By phasing we can reflect and move on to the
next phase. We want to approach with caution, don't need to reinvent the wheel. Mr. Sweet asked
about recreational use, Agent said it might require some out of the box thinking. ATVs are consistent
in this area, perhaps designate as an ORV area.
• Update: 37 Monomoscoy Road West violations (Homeowner: Peter Costill)
Agent said violations were addressed (parked boat/log retaining wall), there will be additional follow
up.
• Discussion: NRCS assessment of Santuit Pond fish ladder
Mr. McKay said there were several suggestions, but really only one viable option. Agent agreed,
option 6 seems to make the most sense. Agent will give it another week for the Commission to review,
then he will draft a letter of endorsement for the Commission to sign at the next meeting.
• Update: Santuit Pond Preserve Committee meeting
Agent said it was a good meeting. Just going to be mutually managed by both towns. Discussion
was mostly about how to improve the abandoned bogs before it becomes cost prohibitive for
restoration. They will apply for grant assessment in the spring to look at different scenarios.
• Update: Eversource right-of-way vegetation maintenance notice to Commissioners
The notice details all of their protocols. Agent said he told them his standpoint, wants to make sure
we're kept in the loop.
• ADDITIONAL TOPICS:
(This space is reserved for topics that the Chairman did not reasonably anticipate would be
discussed).
Paul Rowland (present) is interested in joining the Commission. He will attend the next meeting.
John Swartzbaugh is also interested in joining the Commission.
