Gf,t111\N, Town of Mashpee <br /> O, A `,SPA <br /> 16 Great JVeck Avoad,Arorlh <br /> Alash/gee,Massachusetts 0264.9 <br /> Mashpee Conservation Commission Minutes <br /> Thursday, March 12, 2020 <br /> Mashpee Town Hall <br /> 16 Great Neck Road North <br /> Ockway Meeting Room <br /> Present: Thomas O'Neil, Dale McKay, Steve Cook, Chad Smith, Charles Dalton <br /> Vice Chairman Chad Smith called the meeting to order: 6:00 p.m. <br /> PRE/POST-HEARING AGENDA: <br /> • Minutes: January 9, & January 23 (tabled), February 13, 2020 Minutes <br /> Motion: Mr. McKay moved to approve the 1/9/20 minutes, Mr. O'Neill seconded. <br /> Vote: 5-0 unanimous <br /> Motion: Mr. McKay moved to approve the 2113120 minutes, Mr. Dalton seconded. <br /> Vote: 5-0 unanimous <br /> • 3 Santuit Lane encroachment issues: Town Counsel correspondence.Agent said during a survey <br /> it was discovered that an addition to the home was crossing over into the parcel. We spoke with <br /> Town Counsel about how to address it. We talked about doing something similar to the Lopez land <br /> swap. It would have to go through levels of approval/legislature,Agent will keep everyone informed. <br /> HEARINGS: <br /> 6:00 Daniel J. Kumin, 44 Bayview Road. Proposed removal and replacement of timber wall within NO[ <br /> same footprint; removal of stairs and replacement with stairs and platform; removal of three <br /> trees; removal of float and posts. <br /> Matt Costa from Cape and Islands Engineering presented plans. Agent asked if piles are going <br /> to be below mean high water into ACEC. Mr. Costa said they would have to re-evaluate if DEP <br /> had an issue with it. Agent said it's a significant amount of disturbance in the salt marsh. He <br /> doesn't see how it's permittable, there's no grandfathering scenario. Mr. Costa said they could <br /> relocate the stairs. They were lining up with existing steps. If they'd prefer, they could slide that <br /> over and keep the posts above mean high water. Agent said we'd have to see revised plans. <br /> Mr. Cook said it begs the question, what type of access are they looking for? Agent said it <br /> seems to him that getting a 10A float with a ramp would really provide the best access to the <br /> water. I'm not onboard with shifting it. Mr. McKay said it's hard to understand why the access <br /> is down there. Agent said there's a lot of potential disturbance to the salt marsh. It's not just at <br /> State level, it's local. Mr. Costa requested a continuance to March 26 so he could speak to the <br /> home owners and Harbormaster. <br /> Motion: Mr. McKay moved for a continuance to March 26, 2020 at 6:09pm, Mr. Dalton <br /> seconded. <br /> Vote: 5-0 unanimous <br />
