Owner of record: Commonwealth <br /> of Massachusetts. Continued from 1123 to allow for DEP review. <br /> Home owners were not present. <br /> Motion: Mr. McKay moved for a continuance to March 26, 2020 at 6:15pm due to <br /> Coronavirus, Mr. Dalton seconded. <br /> Vote: 5-0 unanimous <br /> 6:06 Marilyn R. Worth, et al Trustees, 38 Spoondrift Way. Proposed septic system upgrade. RDA <br /> Jeff Ryther from BSS Design presented plans. Agent asked if within 100ft, IA or variances? <br /> Mr. Ryther said no IA, I did send variances, if within 75ft it'd be IA. Agent said he's been out <br /> there multiple times. It's all within buffer zone, no impact, it's an overall upgrade. He <br /> recommends negative determination. Mr. McKay asked if it was going to remain a gravel <br /> driveway, Mr. Ryther said yes. <br /> Motion: Mr. McKay moved for a negative determination, Mr. Dalton seconded. <br /> Vote: 5-0 unanimous <br /> 6:09 Kathy Cramer, Trustee, 214 Waterway. Proposed septic system upgrade. RDA <br /> Jeff Ryther from BSS Design presented plans. Agent said there is no impact, he recommends <br /> a negative determination. <br /> Motion: Mr. McKay moved for a negative determination, Mr. Dalton seconded. <br /> Vote: 5-0 unanimous <br /> 6:12 Kenneth G. Lane, 30 Wilsons Grove. Proposed septic system upgrade. RDA <br /> Mike Pimental from JC Engineering presented plans. Mr. McKay asked if raising the surface <br /> of the ground, Mr. Pimental answered no. Agent said there's not much to add, what type of <br /> equipment is needed? Mr. Pimental said a mini excavator. Agent said he has nothing to add <br /> and recommends a negative determination. <br /> Motion: Mr. McKay moved for a negative determination, Mr. Dalton seconded. <br /> Vote: 5-0 unanimous <br /> 6:15 Michael P. & Candace L. Curran, 28 Flat Pond Circle. Proposed tree removal to allow for RDA <br /> installation of fencing, retaining walls and hardscaping. <br /> Tom Bunker from BSS Design presented plans. Agent said he looked at the permit history, they <br /> had vista pruning. It was unusual, some mature trees removed, allowance for ground cover. <br /> Suppose to have had substantial mitigation-it was never put in. Probably a case of the <br /> homeowner not aware, but in light of this discovery, it would have to be done before with an <br /> enforcement order. Probably will have to scale back the wall. In assessing, we looked at the <br /> impact on wildlife. Scale back so no trees are removed. If scaled back, it can be an RDA. If <br /> not, would be an NOI with conditions. Mr. McKay asked if we have heard from abutters, Agent <br /> said we have not. Mr. Cook asked what the mitigation plan was. Agent described what it should <br /> have been using the photographs on the screen. It was pretty substantial. He recommends if <br /> scaled back, it be an RDA. Mr. Smith said it sounds like a continuance. Mr. McKay said it sounds <br /> like an NOI. Advise as an NOI, seems safer. Agent recommends a continuance. <br /> Motion: Mr. McKay moved for a continuance to March 26, 2020 at 6:12pm, Mr. Dalton <br /> seconded. <br /> Vote: 5-0 unanimous "' <br />
