Shellfish Constable. Agent answered yes, and read comments. Harbormaster has no issue with <br /> this application, as long as the portion of the portion of the fixed pier is replaced by the proposed <br /> ramp and float, it won't be an issue with navigation. Shellfish Constable said she is fine with <br /> this application because it is not a productive shellfish area. Carol Liston from 94 Summersea <br /> Road, called in with a comment. She said she sent a letter from herself with support from her <br /> neighbors to the Commission on January 26, 2020, outlining their surprise at the dock being <br /> built. She stated they were not notified because they are not direct abutters. They are glad there <br /> is no intent to further extend the dock, but they would like to see some portions of the current <br /> dock taken down. She feels there are navigation issues. She would appreciate some conditions <br /> from the Town of Mashpee: 1. That whatever boat is there, is required to be moored on the <br /> west side of the dock. 2. That there will never be a float at the end. 3. Include that when <br /> paperwork is forwarded to DEP, they notify the owners at 94, 90, & 84 Summersea Road. <br /> Agent commented that the current Harbormaster signed off on this, and didn't anticipate any <br /> issues. Navigation is handled at the State DEP Waterways Chapter 91. His recommendation is <br /> that we leave is to Chapter 91 to handle these issues. <br /> John Rousou,90 Summersea Road, called in. He shares the dock that he has with his neighbor, <br /> The Listons. He wanted to express his disappointment with the length of this dock, and that it <br /> was approved in spite of the former Harbormaster's concerns. He suggested there be an <br /> amendment to include 1 or 2 sections of the dock to be removed. <br /> Mr. Burton Liebman from 80 and 86 Summersea Road called in to say that the dock is enormous <br /> and he doesn't know how that was approved. <br /> Mr. Borselli wanted to remind the Commission that this is an amendment to a pier that has been <br /> issued an OOC and a Chapter 91 license. It has been fully vetted by Harbormaster, Division <br /> of Marine Fisheries, Division of Wetlands and Waterways who are the authority on navigation. <br /> It was advertised, as required, in newspapers. The abutters have expressed concerns and <br /> their comments are anecdotal and without a basis of any evidence. There are no docks in close <br /> proximity to the proposed pier. The reason for the length is to get some depth. They simply <br /> want to convert the last two sections from a fixed pier to a ramp and float. <br /> Mr. Sweet asked if the Commission has any questions. Mr. Smith commented that he didn't <br /> hear any Conservation issues from any of the abutters. Mr. O'Neil agreed, and said that <br /> navigation is not their jurisdiction. Mr. McKay agreed that he sees no issue. Mr. Sweet said he <br /> remained neutral, navigation is not our jurisdiction. <br /> Motion: Mr. Cook moved to accept the project as presented, Mr. Smith seconded. <br /> Vote: 4-0 unanimous <br /> 6:03 Town of Mashpee, 664 Great Neck Road South, Proposed Amendment of Order of AOOC <br /> Conditions 43-2968 to allow for modifications to the parking lot to improve boat ramp use and <br /> access. Applicant: DPW Director Catherine Laurent. <br /> Catherine Laurent presented plans. Agent showed images that this was a previous OOC. It's <br /> pretty straightforward, no major changes. Everything is within the performance standards for <br /> coastal banks. This is just to improve navigation in the parking lot. No questions from the <br /> Commission. <br /> Motion: Mr. O'Neil moved to accept the proposed plans to increase the amount pavement <br /> to change the direction of the parking lot in Ockway Bay , Mr. McKay seconded. <br /> Vote: 4-0 unanimous <br /> The following hearings were rescheduled from 3/26 meeting (cancelled due to COVID 19): <br /> 6:06 NJCJ LLC, 21 Metacomet Road. Proposed Amendment of Order of Conditions 43-2964 to AOOC <br /> install an additional pile and reconfigure previously approved piles to allow for addition of a boat <br /> lift. <br /> Mike Borselli from Falmouth Engineering recapped the January 23, 2020 hearing where he <br /> initially presented plans. He is here today with the cover letter and revised plans he submitted <br /> on March 19, 2020. He addressed concerns that Ashley Fisher, the Shellfish Constable, <br />
