brought up at the last meeting. The Agent read Ashley Fisher's comments in entirety. He also
read comments from the Harbormaster regarding navigation. The Agent said he agrees with
the Shellfish Constable's recommendation and would not recommend approval of this project.
The Board agreed with the Agent's recommendation. Mr. Borselli commented that the
Harbormaster was clear that there are no navigation issues. He was confused about issues
with the hoist, which was clarified. It should be verified that I clarified with the Harbormaster
and in the end he has no concerns. The Agent said that's true, and apologized from reading
his original comments, that have since been revised. Mr. Borselli said based on the video of
the January meeting, he's surprised at the Board's position. He requested a continuance before
they take a vote, to give them a chance to watch the video of the January meeting. Katelyn
Cadoret said that her recommendation at the time (previous meeting) was to take the Shellfish
Constable's recommendations The consensus was that additional information be presented at
the next meeting. Mr. Borselli reiterated that at a minimum, the video should be reviewed. Mr.
McKay said he remembers that meeting and would rather err on the side of the applicant and
would prefer a continuance. Mr. Sweet said he's not sure we had a fair hearing tonight. We
should review the video from the last meeting.
Motion: Mr. McKay moved to accept a continuance to May 14, 2020 at 6:24pm, Mr. Smith
seconded.
Vote: 4-0 unanimous
6:09 Susan Wilder, 112 Fells Pond Road. Proposed reconstruction and expansion of existing NOI
timber pier and installation of seven additional posts.
Tim Santos from Holmes and McGrath presented plans. The Agent said some tree/brush
removal was done without permission, but not major. He doesn't consider it to be an issue and
it was mitigated for. No impact to performance standards. Harbormaster and Shellfish
Constable comments not applicable. His recommendation is to close and issue.
Motion: Mr. Smith moved to close and issue, Mr. McKay seconded.
Vote: 4-0 unanimous
6:12 Southworth Mashpee Properties LLC, 8 Grand Vista. Proposed construction of single-family NOI
dwelling.
Mike Ball from Baxter Nye presented plans. Agent said this is pretty straightforward, this is
really just showing the building envelope of what they plan to construct. Additioal details will be
submitted via an amended order. No clearing or construction is to take place until an amended
order with additional details is submitted.
Motion: Mr. Smith moved to close and issue, Mr. McKay seconded.
Vote: 4-0 unanimous
3
6:15 Daniel J. Kumin, 44 Bayview Road. Proposed removal and replacement of timber wall within NOI
same footprint; removal of stairs and replacement with stairs and platform; removal of three
trees; removal of float and posts.
Raul Lizardi from Cape and Islands Engineering presented plans, continued from March 12,
2020 meeting. The Agent said 10A is really Harbormaster's jurisdiction. 10A cannot ever be
pile supported. It's a way to circumnavigate ACEC restrictions on structure below Mean High
Water. No issues with the retaining wall. No other comments. Mr. McKay asked what holds a
10A in place, Agent answered it must be bottom anchored only..no posts or piles.
Motion: Mr. Smith moved to close and issue, Mr. McKay seconded.
Vote: 4-0 unanimous
