The Shellfish Constable, Ashley Fisher said that she will <br /> oversee all operations in the first year as part of the mandatory probation. They will add <br /> additional markers, all gear will be underwater, you will only be able to see floats above water <br /> and they will be black or grey in color so not too visible from land, to be esthetically pleasing to <br /> the homeowners. The Agent commented that any conditions from Ashley would be included. <br /> He asked if this would be at town landing or Ockway? Lisa said either, Drew said it's not really <br /> the Conservation Commission's concern. Ms. Fisher said that DPW had some questions and <br /> she would prefer they use town landing. Agent said he has no other comments. Mr. Sweet <br /> asked how far off shore? Ms. Fisher said the current plan is 100ft offshore. Mr. Sweet said that's <br /> fine, he just wanted to see if there's still access for the public. Agent said he has nothing to add it's a great project. He recommends to close <br /> and issue. <br /> Motion: Mr. Smith moved to close and issue, Mr. McKay seconded. <br /> Vote: 4-0 unanimous <br /> 6:27 Alexander J. Bernhardt II & Allison B. Bernhardt, 37 Birch Way. Proposed landscape RDA <br /> modifications. <br /> Allison Bernhardt presented plans. Agent said he's met on site a few times. He asked if it's <br /> necessary to remove all the trees? It's a concern to take out all trees, he understands the <br /> homeowner feels there's a safety issue. Ms. Bernhardt said not all trees had to be removed, <br /> and she asked if they could tag the few that can stay. Agent said it's a lot. He understands <br /> concerns, he thinks we should work with Allison as far as which trees should go or stay. No <br /> real impact /no other comments. Mr. McKay said he's having trouble seeing a safety issue. <br /> Looks like substantial tree removal. It's not desirable, and his inclination is to not allow, or <br /> suggest a detailed drawing with such an impact. Mr. Sweet said he agrees with Dale. They <br /> should come back with a detailed plan. Mr. Smith asked what's the primary objective, level or <br /> create lawn? Ms. Bernhardt said both. There's no yard. Will be more space, curb appeal, <br /> driveway will be a little safer. I think it will add value and am happy to work with the Agent on <br /> which trees will stay. Mr. McKay said I hear you, you're not alone in these problems, but that <br /> isn't an issue with the commission. Mr. Smith asked the Agent if they can work with the <br /> applicant to save trees? Agent said yes, he understands the concerns. The purview of the <br /> Conservation Commission is really from about the wildlife habitat....there's an opportunity for <br />
